The information you ask for, regarding our Framework Agreement for the
Provision of Technical Project Management, Cost Consultancy and CDM
Principal Designer Services, is as follows:

 

• Suppliers who applied for inclusion on each framework/contract and were
successful & not successful at the PQQ & ITT stages

- Successful tenderers are Buro Four Project Services, Flemming Associates
LLP, Focus Consultants 2010 LLP, Fraser Randall Productions Ltd, Gardiner
and Theobald LLP, Greenway Associates

- Names of unsuccessful tenderers and PQQ applicants are held by the V&A
but we believe are exempt from release under section 43(2) of the Freedom
of Information Act (Commercial interests). The reasoning behind our
decision to withhold this information is set out below.

• Contract values of each framework/contract (& any sub lots), year to

The exemption under section 43(2) of the Act is subject to the balance of
the public interest in releasing the information against the public
interest in withholding it. We do recognise a public interest in knowing
that contracts are awarded fairly by the V&A, that public money is spent
appropriately and that services are provided by competent suppliers.
However, we believe that the disclosure of the names of unsuccessful
tenderers and PQQ applicants would prejudice their commercial interests by
revealing to competitors what business opportunities firms were pursuing
and where they were failing to achieve their aims. Disclosure would also
be prejudicial to the V&A’s commercial interests, as private sector
partners would choose not to tender for work with the V&A if they believed
that commercially sensitive information would be placed in the public
domain. We consider that there is a strong public interest in the V&A
being able to carry out the tendering process in an atmosphere of trust
and mutual confidence, so as not to damage the commercial interests of the
V&A by limiting its ability to attract and negotiate with the best
private-sector partners; and so as not to damage the commercial interests
of tenderers by releasing business-sensitive information. We have
concluded, therefore, that in the circumstances of this case, the public
interest in disclosing the information is outweighed by the public
interest in maintaining the exemption.

 

I hope that this information will be helpful to you. In accordance with
the Freedom of Information Act, the V&A does operate a complaints
procedure and if you are dissatisfied with our response to your request
you may make a complaint, in the first instance to myself as the V&A's
Freedom of Information Officer. If your complaint is not handled to your
satisfaction you also have the right to refer the matter to the
Information Commissioner.
