Dear Slough Times

Thank you for your supplementary request for an un-redacted version of
Appendix C (Outline Integration Plan) of the Outline Business Case for
Frimley Park Hospital NHS Foundation Trust’s (FPH) potential acquisition
of Heatherwood & Wexham Park Hospitals NHS Foundation Trust (HWPH).  We
are unable to provide you with an un-redacted version of the document at
this time as we believe that some of the information within this document
is currently exempt from disclosure under the terms of the Freedom of
Information Act 2000 (FOIA). 

Specifically we have redacted the personal data of FPH and HWP employees
as this is exempt from disclosure under section 40(2) of the FOIA.  This
is an absolute exemption which does not require us to carry out a public
interest test. 

We have also redacted information as we believe the disclosure of this
could prejudice the commercial interests of FPH and/or HWPH and therefore
this information is exempt from disclosure under section 43(2) of the
FOIA.  This is a qualified exemption that requires us to undertake a
public interest test.  The outcome of test undertaken is that we believe
that the public interest in protecting the commercial interests of FPH and
HWPH, and securing the best possible return for public funds, outweighs
the public interest in disclosing this information at this time. 

Information has also been redacted as it is the reasonable opinion of the
Trust’s qualified person (the Chief Executive) that the disclosure of this
information at this time could be prejudicial to the effective conduct of
public affairs and the information is therefore exempt from disclosure
under section 36(2)(c), as the release of the data at this time would be
likely to otherwise prejudice the effective conduct of public affairs.  We
believe there is a greater public interest in withholding this information
as its disclosure at this time could have an adverse effect on FPH and
HWPH’s ability to offer an effective public service.
