amount of information deemed likely to be commercially sensitive. The

I refer to your request for information received on 28/05/2014.  Please
see the information below in response to your request: -

This would include any correspondence between the council, the organisers
of Formula E, contractors (council or Formula E) and others with an
interest in the race or the park

Please see the attached pdf, you will note that some information has been
redacted in order to remove all personal information such as names and
contact details of third parties. Please note that this personal
information is exempt from disclosure under Section 40 (2) of the Freedom
of Information Act 2000 as disclosure would result in a breach of the
first data protection principle. A ‘timeline’ has also been provided,
although please note that this does not constitute a comprehensive
schedule of the information provided to you. Please also note that none of
the meetings referred to were minuted.

A draft legal agreement and the original draft formal proposal, both
provided to the Council by Formula E, are being withheld under section 41
– Information provided in confidence.  This exemption applies because the
release of these details would constitute an actionable breach of
confidence.  This information was provided to the Council in confidence
with the expectation that it would not subsequently be disclosed. Neither
of these documents were progressed beyond the draft stage and Formula E
have advised that they are likely to use these documents in other
negotiations. As such the disclosure of these documents would undermine
their commercial interests, Wandsworth Council is of the view that the
Council would be subject to an actionable breach of confidence if it were
to disclose these draft documents.
