Dear Wirral Metropolitan Borough Council,

There is a Code of Conduct on Wirral Council's website specific to the Planning Committee, see http://www.wirral.gov.uk/my-services/env... .

2.1 of this Code of Conduct states "Inform such applicant, agent or interested party that, in order to avoid accusations of partiality, he/she is only able to offer procedural advice and that any such person should either write to officers of the Council or write or speak to a member(s) who is not on the Planning Committee. This should not however be taken to mean that members who are on the Planning Committee should not listen to the views that the lobbyist wishes to express.

Complete the standard form provided, and forward this to the Acting Director of Regeneration, Housing and Planning. This will enable a record to be kept of any such approach. This form of record keeping will assist individual members to counter any accusations that his or her decision has in some way been biased or partial."

Please could you provide:

a) a blank copy of this standard form and
b) copies of any forms submitted by councillors in the last twelve months (or if this would exceed the 18.5 hours the approximate number of forms submitted in the last twelve months and as many copies of the most recent forms submitted as can be supplied within the 18.5 hour limit).

Wirral Borough Council can confirm that no such forms have been submitted
during the specified timeframe.

 

Unfortunately, due to staff absence we have been unable to find a blank
copy of the form to provide to you. We hope to be able to do this after
Monday 28^th April, and apologise for any inconvenience caused by this
delay.

Dear Wirral Metropolitan Borough Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Wirral Metropolitan Borough Council's handling of my FOI request 'forms detailing lobbying of Planning Committee'.

Although you have responded to my part of my request stating that no forms have been submitted in the previous twelve months, you have not supplied a copy of a blank form within the required twenty day time frame that the law states you should respond to freedom of information requests in. The request was made on the 21st March 2014 and the twenty days expired on 22nd April 2014.

I am therefore requesting this internal review as the information that you hold was not supplied within the twenty day time limit specified in s. 10(1) of the Freedom of Information Act 2000 c.36.

“We have carried out a reasonable search and also spoken to relevant staff
and a standard form does not exist.  We appreciate a standard form is
mentioned on the web page, but this is in error and we are having the text
