As quoted from your Crichel Downs report for the former Waterbeach Barracks, please could you release information on which the exception or exceptions applied and what those exception or exceptions are.

"It has been decided in this instance that an exception or exceptions under the Crichel Down Rules do apply and that the land will not be offered back to the former owners or their successors in title."

Many thanks for your reply.

MOD applied Rule 10 “material change” with a secondary exception of Rule 15(6) “fragmentation”.

Could you please send me a link or original document to the Crichel Down Rules applied when the exceptions were dated and where these Rules are quoted from for clarity.

I also request the justification used which led to these rules being applied, the Minister responsible and the department's professionally qualified valuer making the assessment.

In your recent FOI enquiry you requested information relating to “the
justification used which led to these rules being applied”. I would be
grateful for some clarification of this please. Are you asking why the
Crichel Down Rules were applied to the conveyances in question?

I would like to request any supporting documentation for the reasons why the following could not occur.

"After the termination of hostilities, it was decided that some of the land requisitioned to increase food production should be retained for agricultural purposes, and under Part V of the Agriculture Act 1947 the Minister of Agriculture acquired powers to compel purchase of any requisitioned land which was not sold voluntarily to him, in order to maintain its full and efficient use for agriculture."

The land is currently being used for Agricultural purposes.

In regards to the changes, such as historical buildings.
Would these remain or demolished to return the lands to agriculture,
If not then what report shows this could not occur. Perhaps they are listed due to the 70 or more years of history?

"Having undertaken a physical site inspection, and reviewed documentary evidence, we are of the opinion that, whilst some changes are more material than others, the majority of the Waterbeach Barracks site has undergone a material change in character from its original agricultural state when it was acquired."

Please provide the supporting physical site inspection documents.

“On those parts of the estate where buildings, roads and runways have not been constructed, it is our view that some material change has also arisen as a consequence of afforestation and contamination."

Please provide the supporting documentation relating to the aforementioned 'contamination'.

“However, we do also believe that due to the impact of potential fragmentation on the underlying value of the whole, for the reasons stated within this report, an exception to the requirement to sell elements of the land back to former owners would also apply in accordance with Rule 15(6)(ii).

Please provide supporting documentation which shows the valuation calculation for the 'contaminated' site as a whole, verses fragmented valuation. Please also provide the valuation for each landowner listed in the original notification and supporting valuation calculations showing how these figures were arrived at.

“We have considered also the extent to which the character of land has changed (if not in its physical appearance) by virtue of association with the use of adjacent land. This is particularly relevant to areas of land enclosed by runways and taxiways and also to the generally narrow strips of land at the periphery of the site and beyond the runways and taxiways."

Please provide supporting documentation to show the areas of land with a 'change of character' and those which were unaffected.

“In our opinion, there is therefore strong evidence to support a material change to the whole site. As such, there would be no requirement to offer the land back to the former owners in accordance with Rule 10."

Please provide the supporting documentation and calculation used to determine the 'material change' is enough to include the whole site, please clarify the size in hectares (ha) of the whole site and size in hectares (ha) for the land of 'material change'.
