Dear North East Lincolnshire Council,
I would be grateful if you could inform me as to whether the former North East Lincolnshire Council assistant chief executive, Colin Bulger, received any compromise or similar agreement(s) from the council.
We acknowledge receipt of your information request, which has been given
the reference number NEL/1087/1516.
For a request to be valid under the Freedom of Information Act, section 8
(1) requires that it
(a) is in writing,
(b) states the name of the applicant and an address for correspondence,
(c) describes the information requested.
The Information Commissioner’s guidance ‘Recognising a request made under
the Freedom of Information Act (Section 8)’ clearly states that ‘the
intention of the legislation is for the requester to provide their real
name’. Where a request is made not using the applicant’s real name this
would render the request invalid and affect your appeal rights, as the
powers of the Information Commissioner only extend to requests for
information defined under section 8 of the Act.

The Information Commissioner’s guidance states that providing just a first
name such as Alan, is not sufficient to meet the requirements of section
8. To make your request valid under the Freedom of Information Act and
provide you with a right of appeal, we would ask that you confirm your
name and postal address (please note a PO Box is not acceptable), to
maintain your confidentiality this should not be done through the ‘What do
they know’ website. This information can either be sent to
[North East Lincolnshire Council request email] or to The Freedom of Information team, Municipal
Offices, Town Hall Square, Grimsby, North East Lincolnshire, DN31 1HU. The
name and postal address you provide will be used and held for the sole
purpose of managing your Freedom of Information requests. Please quote our
reference number with your correspondence.
We determine that the information you are asking for if held, is personal
information of a third party. Section 40 (2) of the Freedom of Act 2000
provides an exemption to the disclosure of information which is personal
data of a third party. In this case we determine section 40 (5) applies
and the duty to confirm or deny if the information you have asked for is
held or not does not apply in relation to your request.
If you are dissatisfied with the Council’s handling of your request you
can request an independent review by contacting the Information
Commissioner's Office at Wycliffe House, Water Lane, Wilmslow, Cheshire
SK9 5AF. Please note that the Information Commissioner only extend to
requests for information defined under section 8 of the Act.
