Formal Complaint Statistics

We're waiting for Nigel Ward to read a recent response and update the status.

Dear East Riding of Yorkshire Council,

I write to lodge a request for information under the terms of the FOIA.

The information I seek is as follows:

1) In the time period beginning on 1st April 2011 and ending on the day of your response to this request, please provide:

a) in the case of elected members, the number of Formal Complaints, on a yearly basis;

i) received by the Council,
ii) processed by the Council, and
iii) UPHELD by the Council.

b) in the case of Officers of the rank Director and Head of Service, the number of Formal Complaints, on a yearly basis;

i) received by the Council,
ii) processed by the Council, and
iii) UPHELD by the Council.

2) In the same time-period as (1), above, also on a yearly basis, please provide the number of;

(i) Councillors who, within three calendar months of the date of a Formal Complaint Decision Notice stating that a Formal Complaint (or Complaints) against her/him had been UPHELD, resigned from the Council, and
(ii) Officers of the rank Director and Head of Service who, within three calendar months of the date of a Formal Complaint Decision Notice stating that a Formal Complaint (or Complaints) against her/him had been UPHELD, left the employ of the Council.
(iii) of these (if any), the number of Officers of the rank Director and Head of Service who entered into a non-disclosure agreement (NDA) with the Council.

Thank you for your response.

Rather than moving directly to an Appeal for Internal Review - and possible formal complaint to the Information Commissioner's Office - I hope you will, in the spirit of transparency, embrace the following possible resolution.

You have provided, in your response, the estimate that the provision of the material I have requested, referencing records totalling six-and-a-half years (since 1st April 2011), would require an estimated 7-minute inspection of each of approximately 450 Decision Notices, predicating an estimated total of 52.5 person/hours - which exceeds the 18 person/hour limit set by legislation. Let us say 78 months.

A third of that is 26 months. Counting back from the date on which I lodged my request (24th October 2017), we arrive at 24th August 2015.

You will by now appreciate that one-third of 50.5 person/hours equals 16.83[rec.] person/hours, which falls comfortably within the 18-hour limit.

Hopefully, I can now look forward to your full response based on the constraint to the scope of my request, as set out above, i.e. starting from 24th August 2015.

Dear Mr Ward,

Following your further enquiry regarding the response provided by the
Council to your Freedom of Information Act request, officers have now
provided the following information for a revised period from August 2015.

From 24^th August 2015 to 30 November 2017 the the Council received 10
complaints relating to Senior staff at East Riding of Yorkshire Council.

One in 2015, three in 2016 and up to 30 November 2017, 4 were received.
All of which were for Directors. Two further complaints were received in
2016 for either Director or Head of Service.

We can not identify what was upheld as this was not previously recorded.
