Dear North Somerset Council,

Im requsting a copy to see your Foreign Agent registration and Anti Bribery statement to find out if your foreign agents have has the right to collect monies for council tax purposes in England ?

I also require information regarding your consumer credit license, which I presume you must have in your possession in order to be able to collect money and debt for council tax purposes.

The OFT requires an applicant to stipulate what categories apply to that applicants business when applying for a consumer credit license; therefore, your application, you may or may not have sent to the Office of Fair Trading should contain the categories you are required to select in order to obtain a consumer credit license? The categories are illustrated on the OFT website and are listed as follows:
Category A - consumer credit business
Category B - consumer hire business
Category C - credit brokerage
Category D - debt adjusting
Category E - debt counselling
Category F - debt collecting
Category G - debt administration
Category H - provision of credit information services (whether or not it includes or excludes credit repair and if on a commercial or non-commercial basis)
Category I - credit reference agency.

On top of that I would also request you send me a copy of the actual consumer credit license, issued to you by the office of fair trading. Office of Fair Trading (OFT) website page headed Credit licensing, and pursuant to the Consumer Credit Act 1974, most businesses that provide goods and services on credit or for hire, lend money or provide debt collecting, debt counseling or debt adjusting services to consumers need to have a credit license; and according to the OFT, it is a criminal offense to trade in credit activities without a credit license.

OFT website page headed ‘Validating Credit Agreements’, regulated agreements, whilst unlicensed cannot be enforced by the courts. A validation order would have to be sort to make these agreements enforceable. A validation order will be required if you entered into a credit or hire agreement or carried on an ancillary business when you did not hold a Consumer Credit License covering the relevant Category of business.
