Dear Lambeth Borough Council,

I would like a list of every food business in your borough which is currently operating. On the list I would like the following information on every business:

1. Address and postcode
2. Name
3. Date of last inspection
4. Score of last inspection
5. Class use of business (a1 or a3)
6. Brief description of business

I would like the information in the form of an excel spreadsheet.

If you read the guidance which you have sent me, it is clear that

"
Even when an obvious pseudonym has been used, as good practice a public
authority should still consider the request even though technically it can be
regarded as invalid. This approach could be adopted in cases where identity
is not relevant to the request and, in view of the general principle within the
FOIA of disclosure to the world at large, where the authority is content to
disclose the information. "

And the cases when identity would be relevant are listed clearly:

• a request is being made by the applicant for his/her own personal data
and so would be exempt under section 40(1) of the FOIA (and would
comprise a subject access request under the Data Protection Act
1998);
• a public authority has good reason to believe a requester is using a
pseudonym to shield his/her identity in order to avoid the possibility of
the request being considered as vexatious or repeated; or
• determining whether to aggregate costs for two or more requests in
accordance with the Fees Regulations.

So please enlighten me, which of these three above does my request fall into?

The guidance gives us discretion to accept incomplete names in the
circumstances you quote. It does not however legally oblige us to accept
the request if the format of the name does not meet the standard
specified in the guidance.

The paragraph in the guidance headed "What constitutes a real name?"
gives examples of what is and is not acceptable to make the request
technically valid. This clearly states that a forename initial with a
full surname is acceptable whilst a full forename with an initial only
for a surname is not.

Dear Janis,

Please find attached a list of the food businesses as you requested. We
have childminders registered with us but they are not food businesses and
as these are individuals dealing with children they have not been listed
here. The Planning class of business has also not been listed as we do
not hold that on our food database and to cross check these against the
Planning list would have taken in excess of 18 hours to achieve - that
said, the brief description of the business may give you the information
you require as restaurant and take away premises will be A3 use and retail
type premises will be A1 use. I do hope this information is useful to you.
