Good afternoon,
I write further to your request for information under FOI legislation,
received by West Yorkshire Police on 18/01/2024.
You requested the following information:
Now a significant length of time has passed, I trust that the
investigation process has been completed.
Relating to the incident previously described here (Link to WYP website
regarding Leeds Incident involving 16 year old, press release no longer on
website), please could you provide the following:
1) Any statements or documents provided to the professional standards
directorate
2) Communications to/from the professional standards directorate
3) Any report(s) produced by the professional standards directorate
4) The outcome of the professional standards directorate investigation
Further, could you clarify why the press release has now been taken down?
Section 17 of the Act provides:
(1) A public authority which, in relation to any request for information,
is to any extent relying on a claim that information is exempt information
must, within the time for complying with Section 1(1), give the applicant
a notice which:-
(a) states the fact,
(b) specifies the exemption in question, and
(c) states (if that would not otherwise be apparent) why the exemption
applies.
The Freedom Of Information Act 2000 obliges us to respond to requests
promptly and in any case no later than 20 working days after receiving
your request. We must consider firstly whether we can comply with s1(1)(a)
of the Act, which is our duty to confirm whether or not the information
requested is held and secondly we must comply with s1(1)(b), which is the
provision of such information. However, when a qualified exemption applies
either to the confirmation or denial or the information provision and the
public interest test is engaged, the Act allows the time for response to
be longer than 20 working days, if the balance of such public interest is
undetermined.
In this case we have not yet reached a decision on where the balance of
the public interest lies in respect of either of the above obligations. We
estimate that it will take an additional 20 working days to take a
decision on where this balance lies by virtue of Section 30 Investigations
And Proceedings Conducted By Public Authorities and
Section 31 Law Enforcement.

request. Please be assured that we will endeavour to send a response out
to you as soon as possible.

I am writing to request an internal review of West Yorkshire Police's handling of my FOI request 'Followup to FOI 1757169/23'.
In your public interest test, you have stated multiple times that "To prematurely release information pertaining to an ongoing investigation into the conduct of an officer would undermine the investigation process". However, the investigation has been completed by the IOPC and as such, I believe that this public interest test is incorrectly executed.

Further to your below request for an Internal Review, as per the complaint rights outlined in our response letter 'Complaints will only be treated as valid, if they are received by West Yorkshire Police within a 60 day timeframe from the date of the decision letter. They must include the original FOI Reference Number and can only be submitted in writing'
