As set out in the FOI response to which you originally referred:

 

The Buckinghamshire Grammar Schools are all academies and their own
admissions authorities and they are, therefore, responsible for  the
transfer test and selection review/appeal process. We administer the
process on behalf of The Buckinghamshire Grammar Schools (TBGS) but do not
‘hold’ this information for the purposes of the Freedom of Information Act
(FOIA) 2000. Therefore, requests about the test/selection reviews/appeals
should normally be directed to TBGS and/or each individual school directly
where a question relates to an individual school.

 

The Council, however, may hold information on the test in the following
circumstances:

 

1) Where TBGS makes available information on the test, which we then use
for our own purposes (for instance, TBGS routinely publishes information
on the test)

 

2) Where TBGS and BCC share information for a specific purpose and an
information set is created, which means both parties then ‘hold’ that
limited information if both parties then use it for their own purposes
(please note that the FOIA would not require public authorities to share
information to create an information set)

 

In this instance, TBGS and BCC would need to share information to create
the information set that you are seeking and this means that neither party
holds the information for FOI purposes and, therefore, we unfortunately
cannot help in this instance.

I am writing to request an internal review of Buckinghamshire County Council's handling of my FOI request 'Follow up request for non-disadvantaged test takers' scores'.

It is clear that the council were at one point in physical possession of the information I am requesting because this was used by Sarah Callaghan, Director for Education to estimate the number of children likely to benefit from a reduction in the pass marks referred to in this request https://www.whatdotheyknow.com/request/b.... The actual reason for refusal is very ambiguous. I can conceive three possible interpretations.
1. The council have destroyed this information.
2. The council are suggesting I should instead request this information from TBGS.
3. TBGS routinely publish this information so disclosure is exempt under s.21.

Responding to each possible reason for refusing to provide this information in turn.

1. If the council have destroyed this information I would like to understand when it was destroyed. I note that the council were able to provide the data for disadvantaged applicants which was based on the requested information as recently as 17 April (see https://www.whatdotheyknow.com/request/s...) so the council were in possession of a subset of the data until recently. I would like to understand if the information was destroyed as a consequence of my requesting it.
2. The information I am seeking meets the example (#2) given by the council for information held by the council, “Where TBGS and BCC share information for a specific purpose and an information set is created, which means both parties then ‘hold’ that limited information if both parties then use it for their own purposes”. This information was used by Bucks Council to understand outcomes for disadvantaged children applying to grammar schools and therefore, by your own definition, is 'held' by the council.
3. Your response says, “TBGS routinely publishes information on the test” If the council believe that the information I have requested is exempt under s.21 then I would like to know where this information is published. I am not aware of TBGS routinely publishing any data relating to their test results.

Dear Buckinghamshire County Council,

Whilst the Freedom of Information Act is considered 'motive blind' it may help to explain that I am trying to understand how the distribution 11+ test scores of children who are known to be in receipt of Pupil Premium compares against those who are not in receipt of Pupil Premium. Because Bucks' 11+ is 'opt in', the data is very representative and each year ~10,000 sit the test making this information invaluable.

Those on Pupil Premium make up about 7% of test takers. To understand how they compare to the wider group I originally submitted a request on 24 March

The council replied providing *only* the scores of those in receipt of Pupil Premium funding.

I concluded this was due to a misunderstanding. Rather than continue with that request, which I thought might make it look like the council were taking too long to respond I completed that request and started this one afresh to get the remainder of the information I was seeking. On 24 April I asked for, “the test scores of the *non* disadvantaged test takers.” I would freely admit my intentions would have been clearer if had I requested “the test scores *including* the non-disadvantaged test takers.” To me these are interchangeable. If I have all the scores it is an extremely trivial matter to remove those in receipt of PP funding and be left with those who are not.

At that point it would have been really helpful if I had been given some advice and assistance as to what information is held. https://www.legislation.gov.uk/ukpga/200... As I explained (24 April), “It is difficult to request the correct information without knowing what format it is held in.” Instead of advice and assistance I was told that the council do not hold the information. I would contest this and say the council *do* hold the information, just not in the exact format I had requested.

I asked for a review and five weeks later received a letter from head of legal services saying my only recourse is to refer this to the Information Commissioner. Despite the tone of Mr Hollis’s letter, I would still prefer to resolve what I believe stems from a simple misunderstanding without having to involve the ICO.

Please can you provide the test results for all pupils entering Y7 in 2017 and 2018. If it is not possible to include "in or out of county" without processing the information then please don't say you don't have the information simply because it is not *exactly* as requested. I am not asking you to process the information to extract just those who are not in receipt of Pupil Premium function because I am very capable of doing this myself.

As you acknowledge, your previous request was limited to 'non-pupil premium' children or 'non-disadvantaged test takers' in your terminology. I accept that it would now seem that it was not your intention to so limit your request. However, we can only base our responses on what is asked for and there was no reason to believe that you were in fact seeking something else.

As I understand it, you are now requesting by pupil data for all children who took the test for 2017 and 2018 entry regardless of their pupil premium status, which in any event is not generally recorded in relation to the test.

I am sorry, if my interpretation is correct, I need to redirect you back to our response of the 21st May:
