Follow-up on failure to respond to F.o.I Request regarding duties under Mental Health Act

Response to this request is long overdue. By law, under all circumstances, Falkirk Council should have responded by now (details). You can complain by requesting an internal review.

Dear Falkirk Council,

I would like to draw your attention to a Freedom of Information Request regarding duties under the Mental Health Act made by colleague Rachel Stewart on December 14th 2011. It appears that you did not provide the information requested ? Is this correct? Ms Stewart is on leave and I am now dealing with this matter. I have copied the previous correspondence below but the questions that we would like an answer to are the following:

1. Please can you outline what the Council is doing specifically to
fulfil its duties under Section 25 of the Mental Health (Care and
Treatment) (Scotland) Act 2003; and what procedures the Council has
in place to monitor the fulfilment of these duties?

2. Please can you outline what the Council is doing specifically to
fulfil its duties under Section 26 of the Mental Health (Care and
Treatment) (Scotland) Act 2003; and what procedures the Council has
in place to monitor the fulfilment of these duties?

Could you please let me know if you will be providing the requested information ?
