Please provide:

For each of the 12 months to today's date, the total number of requests received that month and the number of requests responded to within the 20 day deadline.
If held, for each month please also provide the number of reuqets responded to within 20 days as a percentage of the total received.

FOI statistics on requests that the Department has considered under the Act since 2005, alongside other central government
bodies.

I can confirm that the Department holds the remainder of the information you have requested but this data forms the basis
of figures to be published by the Ministry of Justice with the annual and the 4^th quarter statistics for 2013.

The information for the 4^th quarter (October to December) 2013 and the information on internal reviews will be published
in early 2014. To release now would pre-empt that publication schedule. Therefore we are withholding this information at
this time under section 22 of the Act (Information intended for future publication).

Section 22 of the Act is a qualified exemption which means that a public interest test needs to be carried out, and in
doing so the following factors have been considered:

·         It is acknowledged that there is a general public interest in disclosure because of the need for there to be
open and transparent government and that the sharing of information with the public should be free and open. 

·         The public interest in permitting the Department to publish information in a manner and at a time of own
choosing is important. It is part of the effective conduct of public affairs that the general publication of information
is a conveniently planned and managed activity within the reasonable control of the Department which should not be rushed
into premature publication.

·         The Act recognises that public authorities must have the space to determine their own publication timetables in
order to allow the necessary preparation, administration and context of publication. Disclosure of information which
supports this data is scheduled to be published by the Ministry of Justice in the near future. Therefore to prematurely
disclose this information may disrupt the Government’s consistent approach to communicating this information to the public
at the same time.

The arguments for and against release have been considered and it is the Department’s view that the balance of public
interest falls in favour of the maintenance of this exemption at this time.

The Department does not hold information relating to the type of requester i.e. from an individual or journalists. The
Freedom of Information Act is applicant and motive blind. In other words requestors are not obliged to say who they are.
Statistics relating to requests from any particular categories of requestor cannot therefore be maintained.

If you are unhappy with the way your request has been handled, you should make a complaint to the Department by writing to
me within two calendar months of the date of this letter.  Your complaint will be considered by an independent review

I would like review of q 2. I looked at the data you published on the link and it doesn't look like it contains this part of the info in my request:

The total number of open requests you are dealing with at the present time.

Of these, please give the number that have exceeded the 20 day deadline for response. For each of these requests that have exceeded the 20 day deadline:

Please provide the wording of the request.
The date the request was received.
The date the request was due.

Please either provide this information I requested unless you are able to confirm that the next publication will contain the information in q 2.

Dear Mr Myles,
I am writing in response to your further email of 30 December 2013 in
which you requested an internal review of the handling of your earlier
request for information.

I have dealt with your request under the Freedom of Information Act 2000
(“the Act”).

We have revisited this part your original request for information “The
total number of open requests you are dealing  with at the present time.
Of these, please give the number that have exceeded the 20 day deadline
for response. For each of these requests that have exceeded the 20 day
deadline:
Please provide the wording of the request.
The date the request was received.
The date the request was due.”

The attached table shows details of requests that were received before the
end of September 2013 and which were outstanding on the date of your
original request (1 December 2013). You will note that there were 7 such
outstanding requests at that time.

We are witholding the details of requests that were received during  the
4^th quarter of 2013 (October to December) and which were outstanding as
at 1 December 2013.  We are doing so for the same reasons given in our
response to you on 24 December 2013 as this  information forms the basis
of figures to be published by the Ministry of Justice with the annual and
4^th quarter statistics for 2013. To release now would pre-empt that
publication schedule and it is being withheld at this time under section
22 of the Act, (Information intended for future publication)

We have not yet undertaken a review as we are now able to provide this
information.  However, if you would like to us to hold a review we would
be happy to do so, but hope this is unnecessary as this information is now
attached.
