Subject: Freedom of information requests received

 Thank you for your request for information which has been dealt with
under the terms of the Freedom of Information (Scotland) Act 2002.
Unfortunately, the Council is able to meet only part of your request,
namely the attached spreadsheet with details of all the freedom of
information requests received from 1st January 2010 to date (12/07/2012).

 
There are 3509 records on the spreadsheet and unfortunately some of the
older requests do not have a subject heading. In order to identify the
department responsible for providing the information for the response, and
to complete the spreadsheet with the subject heading, each record we hold
would require the file to be looked at individually. To provide you with
this information your request would fall into the category of a
‘manifestly unreasonable’ request under regulation 10(4) (b) of the
Environmental Information (Scotland) Regulations and we are not obliged to
respond.

 
This exemption also requires the application of the public interest test
to ascertain if withholding the requested information outweighs the public
interest in disclosing the information. In this instance, whilst there may
be public interest in knowing which department provided the response I
consider that there is a greater public interest in the Council being able
to undertake their normal programme of work.

I appreciate that our decision may disappoint you and I am sorry that we
have not been able to release all the information you requested on this
occasion. If you are unhappy with the way we have dealt with your request,

We are unable to provide you with this part of the information you have
requested as the cost of locating, collating and providing you with the
information is greater than the statutory maximum of £600.

 
Section 12 (1) of the Act does not oblige a Scottish public authority to
comply with a request for information if the authority estimates that the
cost of complying with the request would exceed the statutory limit.

 
The total cost of complying with your request is £1290.00.  This sum has
been calculated as follows:
 
• Staff time, 3445 records @ 1.5 minutes per record = 86 hours @ £15 per
hour.
 
You may wish to refine and resubmit your request so that it reduces the
cost to within the prescribed limit. Please contact me for further advice
on refining your request quoting the above reference number.

Further to our telephone conversation regards missing foi information from the response I received by the City of Edinburgh Council. In a previous response to another foi requester, Samerah Ul-Hassan Solicitor For Head of Legal & Administrative Services advises "I can advise that the City of Edinburgh Council received 109 freedom of information/environmental information requests in respect of statutory notices during the period 23 August 2011 – 23 December 2011". Comparing the response received from your Sue Galloway it is perfectly clear that there seems to be a lot of information "missing". Therefore please review my request.
