Dear Scottish Water,

I am making this request under the Freedom of Information Act 2000. I am attempting to find which areas have received the most water complaints in the UK.

My questions are as follows:

1) How many water complaints did you receive in the years, 2021, 2022 and 2023?

2) What are the reasons for the complaints?
a. The quality of the water
b. The water pressure
c. Interruption to water supply
d. Unhappy with service
e. Water pipes
f. Costs
g. Damages
h. Other, please specify

3) How much have you had to pay out in connection with water complaints during the years 2022, 2022 and 2023? In pounds (£).

Thank you for your request for information.  Scottish Water has determined
that this was a request for Environmental Information and therefore we are
required to deal with your request under the Environmental Information
(Scotland) Regulations 2004 (EIRs).  We have applied the exemption
contained in section 39(2) of FOISA and will deal with your request for
environmental information under the EIRs alone. 

The Environmental Information (Scotland) Regulations 2004 (EIRs) sit
alongside Scotland's FOI Act and govern access to environmental
information held by Scottish public authorities.

In Response to Point 3

Our Customer Relationship Management System (CRM) keeps track of every
interaction with Scottish Water. We update each case in our CRM system as
it goes on, with details of customer and Scottish Water communications
such as emails, phone calls, and site activities and work updates.
However, this does not cover Service Standard payments, so we can only
give values without categories.

Where we have advised above that Scottish Water does not hold any or the
full information requested it is excepted under Regulation 10(4)(a) of the
Environmental Information Regulations 2004. The text of which is
reproduced below;
(4) A Scottish public authority may refuse to make environmental
information available to the extent that;-
(a) it does not hold that information when an applicant's request is
received.
The exception in regulation 10(4)(a) is subject to the public interest
test in regulation 10(1)(b) of the EIRs.

What this means is that Scottish Water can only withhold the information
if the public interest in maintaining the exception outweighs the public
interest in disclosure.

As Scottish Water does not hold the information in question there is no
public interest in requiring that the information be made available.

I appreciate this exception may appear odd, but this is essentially a
technical point as we are obliged under the legislation to carry out a
public interest test for this exception, but we cannot provide information
that we do not hold.
