RE: EIR REQUEST REFERENCE: LU11002 (quote this reference in the subject
line in all future communications relating to this request)
Please see the Environmental Information Regulations request on
Caseworker. You are responsible for this case now and you need to do the
following before the statutory deadline of 05/10/2023:
1. Read through the request and decide if any exemptions might apply (see
below).
2. Consider if the request is clear enough to answer. If it isn’t, seek
clarification.
3. Create ‘tasks’ on caseworker to other staff or teams as needed for any
information you might need for the response as soon as possible.
4. Draft a response to the question being asked using the templates on
caseworker. Make sure you are answering the question fully. Sometimes
requests come in from people whose name you might recognise and you might
be tempted to respond to them on the basis of their specific case, but you
should not – Remember requests are ‘requestor blind’ and available to the
world at large, not just the person you’re writing to.
5. Check your letter and every page of your attachments (if applicable) to
make sure no personal information is included. If it is, speak to us.
6. Once the draft is complete, send it to your service manager to sign off
on behalf of the Council (unless you are a service manager). Create a task
on caseworker to show this.
7. Send the approved letter (and attachments) to the customer using
caseworker if possible (or save a copy on there if sent another way).
The final response must be sent to the customer before 05/10/2023. This
is a statutory obligation. If this is not possible, please email us with
an explanation as to why so we can give you guidance.
If this case has been incorrectly assigned, please email us immediately so
we can re-allocate it or, if you know who should deal with it, please
re-allocate it on Caseworker yourself.
Templates for responses are now within Caseworker. Please select the
relevant template for EIR which you can then edit. Some template options
include:
EIR – Data Held
EIR – Data not held
You must make sure all internal and external communications regarding the
request and the response to the customer are saved on Caseworker.
You can see a list of exemptions and more information generally at
www.ico.org.uk/for-organisations/guide-t...
Some of the more common reasons we see are below:
The request is manifestly unreasonable;
Personal data about individuals is included;
We don’t hold the information;
The request is too general;
Internal communications;
The document is unfinished;
Confidentiality of proceedings;
The information was provided to us by a third party ‘in confidence’;
Protection of the environment will be adversely affected.
If you think an exemption might apply to all or part of the request,
please email us and we will be able to give you guidance on how to
respond.
Do not delay when dealing with any aspect of this request as it could have
significant consequences for the Council if we do not comply with our
statutory duties.
To contact us about this case, please either email [Luton Borough Council request email] or
create a task on Caseworker and allocate this to the FOI team.
Your sincerely
Sarah Cave
