Dear Ms R
I have acknowledged your request for an internal review dated 18 December
2009.
In reference to your request `How many heads of departments hold other
positions of employment, what is that employment and who are those
people?' the internal review has been concluded and I uphold the decision
given by Mr Yu.
As stated by Mr Yu this information is not held by the Royal Borough of
Kensington and Chelsea and as a public authority we are not obliged to
create any information in satisfaction of a request.
Subsequently if this information was held by the Royal Borough of
Kensington and Chelsea a part disclosure or refusal of request would have
ensued as ` what is that employment and who are those people' would be
exempt from release due to section 40 of the Freedom of Information Act
(absolute exemption) Personal information.
Complaints
I trust this has satisfied your request for a review. If you are unhappy
with outcome of the review or in how this request has been handled you
have a further right of appeal to the Information Commissioner who is
responsible for ensuring compliance with the FOI act.
Regards
Derek Myers
