FOI Request - Public sector off-payroll (IR35) reforms
Dear Loughborough University,
In April 2017 Government introduced new rules into the public sector called the off-payroll reforms, commonly referred to as “IR35”.

We understand you planned for this and developed a set of internal guidelines to be used when on boarding flexible workers, or contractors.
Please can you:
1. send us a copy of your internal guidelines used for this,
2. send us any policies you use surrounding this.
3. send us any documents you use to explain your policies to agencies who supply workers.
4. Send us your internal guidance explaining how you assess the status for each contractor.

In response to your Freedom of Information request dated 11 December 2018,
please find below information relating to your enquiry. Please accept my
apologies for the delay in responding.
1. send us a copy of your internal guidelines used for this.
See attached plus the answer to question 2
2. send us any policies you use surrounding this. IR35 checks
are part of the contract award process. Internal guidance was circulated
in March 2017.We have no other policy or internal guidelines, other than
to use the HMRC ESS tool as the primary method to determine IR35 status.

3. send us any documents you use to explain your policies to
agencies who supply workers. Not applicable – no documents exist since the
University does not use agency workers.
4. Send us your internal guidance explaining how you assess the
status for each contractor. We use the HMRC ESS tool.
