In April 2017 Government introduced new rules into the public sector called the off-payroll reforms, commonly referred to as “IR35”.

We understand you planned for this and developed a set of internal guidelines to be used when on boarding flexible workers, or contractors.

Please can you:
1. send us a copy of your internal guidelines used for this,
2. send us any policies you use surrounding this.
3. send us any documents you use to explain your policies to agencies who supply workers.
4. Send us your internal guidance explaining how you assess the status for each contractor.

I write in response to your recent Freedom of Information request relating
to payroll reforms at the University.  A copy of your full request is
attached below.

 

The information you requested is shown below.

Please can you:

1.            Send us a copy of your internal guidelines used for this

Response: the University has an ‘IR35 Guidance’ document. A copy of this
is attached.

 

2.            Send us any policies you use surrounding this.

Response: the University uses the most appropriate method to fulfil a work
requirement whether that be through permanent, fixed term, agency, or
contractors.

 

Section 21: information reasonably accessible to the applicant by other
means

The University has a Recruitment and Selection Policy. It is already
published on our website and can be found here:

3.            Send us any documents you use to explain your policies to
agencies who supply workers.

Response: the University does not have documents (or policies) in place in
relation to agencies. Each engagement would be assessed for whether IR35
applies, the majority if not all of which would fall within IR35 and need
to be taxed/national insurance deducted. It is the agencies’
responsibility to ensure any individual engaged are assessed for IR35 and
paid appropriately. The default position of the University is that all
worker contracts must be treated as being inside IR35 and subject to
deductions.

 

4.            Send us your internal guidance explaining how you assess the
status for each contractor.
