Dear Sir/Madam,

I am writing to you under the Freedom of Information Act 2000 (“the Act”) to request the following information:

1. Please provide the sum of legal fees and costs that the Trust has spent on defending litigation and threatened litigation of the course of the past 5 years.
2. Whether the Trust has legal insurance in place which covers its legal fees and costs. If so, please provide details as to the extent of this insurance, together with what the premium is.
3. Please set out what Mr Emms, Chief Executive, receives as his current annual salary, together with any bonuses he has received over the past 5 years.

I look forward to your response within 20 working days, as stipulated by the Act.

Thank you for your Freedom of Information Act request 270 received on 26
October 2019.  In order for us to ensure that we properly consider the
request, and in particular the specific categories of information you have
sought, we need some further clarity from you. 

  

It would greatly assist the consideration of your request if you could set
out in more detail what you mean by the phrase ‘threatened litigation’. 
As you may appreciate, there are many different scenarios in which it
could be suggested that formal litigation has been ‘threatened’.  For
instance, it may be that a complaint contains a suggestion of potential
recourse to legal action but which never materialises as the individual’s
concerns are resolved through our complaints process.  We wonder whether,
by ‘threatened litigation’, you are referring to matters in which the
Trust has been served with a formal Letter of Claim i.e. a specific,
positive indication of legal action in accordance with the relevant
Pre-Action Protocol, but before formal proceedings have been served.  Are
you content for us to interpret your request in this manner?  Or did you
have a different interpretation in mind?  Please consider that the more
vague your request is, the more difficult it will be for us to provide you
with any meaningful information in response.
