FOI request for SmartNet Contract

I would be most grateful if you would provide me, under the Freedom of Information Act, details in respect to the contract below.

Smartnet

The details we require are:

• Suppliers who applied for inclusion on each framework/contract and were successful & not successful at the PQQ & ITT stages*
• Contract values of each framework/contract (& any sub lots), year to date
• Start date & duration of framework
• Is there an extension clause in the framework(s)/contract(s) and, if so, the duration of the extension?
• Has a decision been made yet on whether the framework(s)/contract(s) are being either extended or renewed?
• Who is the senior officer (outside of procurement) responsible for this contract?

For clarity, the details of the successful and unsuccessful suppliers are kept in the strictest confidence. These details are used only to contact and support suppliers regarding their bidding activity for the relevant contracts.

I am replying to your information request of 11 January 2019, regarding
the IPO's Smartnet contract.  You can find most of the contract details
you requested on the Government Contracts Finder database published online

Please note though that we regard details of unsuccessful applicants as
exempt from disclosure under s.43(2) of the Freedom of Information Act,
because disclosure would be likely to prejudice the commercial interests
of such companies in the event of their applying for similar contracts in
the future or elsewhere.  In that event, failure to obtain a previous
contract could unfairly damage their chances of future success.   

 

Your assurance that you intend to keep information about unsuccessful
contract bidders in strictest confidence cannot be fulfilled, even
supposing we would be prepared to disclose it to you, as you have chosen
to make your request via a website that automatically publishes all emails
exchanged between requesters and public authorities, including this
response.

 

Regarding the successful bid, the IPO asked for an initial 12 month
contract with the option to extend up to 2 years.  The initial 12 months
ends on 30 June 2019.  A decision has not been made on whether to extend
or renew the contract beyond that date.

 

You also asked for the details of the senior technical officer responsible
for this contract.  That information is also exempt from disclosure under
s.40(2) of the FOI Act, as it consists of personal information of a civil
servant who is not occupying an outward facing role, so in our view
disclosure would contravene the first data protection principle, which
requires that personal information be processed lawfully, fairly and in a
transparent manner.  In the absence of consent to disclosure from the
individual concerned we have decided to withhold his or her identity.

 

I appreciate that our response may be disappointing to some extent.  If
you are dissatisfied with the handling of your information request, you
have the right to ask for an internal review. Internal review requests
should be submitted within two months of the date of receipt of this email
and should be addressed to [2][Intellectual Property Office request email] . If you are not content with
the outcome of the internal review, you have the right to apply directly
to the Information Commissioner for a decision. The Information
