Dear Kirklees Borough Council,
I am writing to request the following information under the Freedom of Information Act 2000.
Q. 1. i.) Please state the local authority’s expenditure (including use of Government grants) on clearing the arrears of tenants in the following financial years.
a. 2017/2018
b. 2018/2019
c. 2019/2020
d. 2020/2021
e. 2021/2022
ii.) For each of the above years, please provide a breakdown of expenditure on clearing the arrears of council housing tenants, housing association tenants and private rental sector tenants.

From our preliminary assessment, it is clear that we will not be able to answer your request without further clarification.
The Council requires further information in order to identify and locate the information you have asked for. In particular, it would be useful to know:

What do you mean by assisting the ongoing renting costs?
Once you have clarified the information you require, I will action your request. If I do not receive clarification within a month, this question will be considered to have lapsed.
• Under section 1(3) of the Freedom of Information Act 2000 (FoIA), a public authority need not comply with a request unless any further information reasonably required to locate the information is supplied.
• Under regulation 12(4)(c) of the Environmental Information Regulations 2014 (EIR), a public authority can refuse to answer a request that is too general, provided the public authority has gone back to the requester and asked for extra information, offering a advice and assistance to help to explain, clarify or rephrase their request.
In this case the Council considers that the EIR apply / FoIA applies.

Thank you for your response.
Regarding your request for clarification on Q1:
I understand that some councils are using Government grants to pay off the rent arrears of tenants in order to avoid evictions. So, by clearing I mean either the use of such money to pay off tenants’ arrears or in the case of council housing tenants it would be writing off the arrears as the rent those tenants owe are to the Council.
Regarding Q2, if the council has been using Government grants to pay off tenants’ arrears I would be interested in knowing what type of tenants benefited from this – and the total amount spent on each type of tenant.
i.e. £20,000 on housing association tenants, £13,000 on council tenants, and £0 on private sector tenants

• 2018/2019 - £36,113.00 written off by the Local Authority
£4241.88 written off by a Debt Relief Order
• 2019/2020 - £5123.18 written off by the Local Authority
• 2020/2021 £28,723.61 written off by the Local Authority
• 2021/2022 £41,659.64 written off by the Local Authority
£4178.05 written off by a Debt Relief Order
Housing Solutions:
• 2017/2018 - NIL
• 2018/2019 £100 (council tenants). Total for year - £100
• 2019/2020 £529 (council tenants), £3336 (private rented tenants).
Total for year - £3856
• 2020/2021 £713 (council tenants), £94 (housing association tenants).
Total for year - £807
• 2021/2022 £26,953 (council tenants), £5,294 (private rented tenants),
£157 (housing association tenants). Total for year - £32,404
NB – please note that we do not hold information on whether these payments
either fully or partly cleared the arrears relating to each tenant.
