I am writing in response to your e-mail below requesting information from
Cardiff and Vale University Health Board (the UHB) under the Freedom of
Information Act 2000.

 

The Freedom of Information Act 2000 gives individuals the right to access
official information. The Act allows the right to request any recorded
information held by a public authority, such as Cardiff and Vale UHB.  A
request can be made for any information it is thought a public authority
may hold. The right only covers recorded information which includes
information held on computers, in emails and in printed or handwritten
documents as well as images, video and audio recordings.  

 

A request can take the form of a question, rather than a request for
specific documents, but an authority does not have to answer your question
if this would mean creating new information or giving an opinion or
judgment that is not already recorded.

 

As you are making a request under the Freedom of Information Act the UHB
will consider your request in accordance with the Act and in line with the
appropriate guidance issued by the Information Commissioner as detailed
below.

 

 The UHB will:

 

• identify which questions amount to requests for information held on
record;

 

• be ready to offer advice and assistance that is reasonable in the
circumstances; and

 

• provide a response in line with the requirements of the legislation.  

 

I would now like to confirm that your request has been forwarded to the
relevant department to action. A further response will be issued in due
course.

 

As your request is being dealt with under FoI, there is a deadline of 20
working days for response to be issued.

Dear Cardiff and Vale University Health Board,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Cardiff and Vale University Health Board's handling of my FOI request 'FOI - HC Corr'.

In your response, you state the reason for applying the exemption is that my request seeks "namely information which has been received from, or transferred to, the Officers of ‘The Infected Blood Inquiry’,". However that is not what I asked for, what was asked for was "correspondence between the Haemophilia Centre Director and other members of staff" relating to certain topics / keywords - that is your staff, at no point in my request did I ask for correspondence between the Haemophilia Centre Director and " the Officers of ‘The Infected Blood Inquiry’" - I therefore consider your response and its explanation invalid.

Dear JJ Evans,

 

Reference:  FoI/19/102 Infected Blood Inquiry

 

I write further to your email of 3 April 2019, to advise that I have now
completed an internal review of Cardiff and Vale University Health Board's
handling of your FOI request, referenced in your email as 'FOI - HC Corr'.

 

I can confirm that having reviewed the response provided to you by our FoI
team, and discussed the rationale for the response with the individuals
involved in its preparation, I have concluded that the decision not to
release the information requested was reasonable and in line with the
provisions of Section 32 (2) of the Freedom of Information Act 2000. This
states:

 

(2) Information held by a public authority is exempt information if it is
held only by virtue of being contained in—

(a)any document placed in the custody of a person conducting an inquiry or
arbitration, for the purposes of the inquiry or arbitration, or

(b)any document created by a person conducting an inquiry or arbitration,
for the purposes of the inquiry or arbitration.

(3)The duty to confirm or deny does not arise in relation to information
which is (or if it were held by the public authority would be) exempt
information by virtue of this section.

 

I have also concluded that the initial response was not as clear as it
should have been. The response should have clearly stated that the
information requested, i.e. copies of emails and other correspondence
between the Haemophilia Centre Director and other members of staff, during
the period 1st June 2018 - 31st December 2018, that relate to: Infected
Blood / Infected Blood Products / Infected Blood Inquiry / Contaminated
Blood have been provided to the Infected Blood Inquiry as part the Cardiff
and Vale University Health Board’s evidence pack. For this reason, as
stated above, Section 32 (2) of the Freedom of Information Act 2000
applies.

 

I hope that this response helps to clarify matters. Should you wish to
discuss the content of this letter please do not hesitate to contact me.
