We are dealing with your request under the Freedom of Information Act 2000
and we aim to send a response by 5 September 2017 - this is 20 working
days from the date of receipt.
 
The Freedom of Information Act 2000 may restrict the release of some or
all of the information you have requested. We will carry out an assessment
and if any exemptions apply to some or all of the information then we
might not provide that information to you. We will inform you if this is

I am writing to request an internal review of Hammersmith and Fulham Borough Council's handling of my FOI request 'FOI - Full policy, protocol and information on Disabled Parking Bay (including Designated Disabled Parking Bay).'.

You have provided "some" of the information requested. You have not provided, for example but not limited to;

1. Details of the internal process, protocol etc.
2. Third parties involved i.e. who undertakes your medical assessments?
3. Appeal process etc.
4. "General principals" indicate a summary of a much larger process details of which you haven't provided.
5. The time frames involved would be key information.
6. How are staff guided internally or is this just a 'Free for all"?

We write regarding your request for an internal review, received on 6
September 2017.

As was explained in our acknowledgement of your request, the Information
Commissioner’s Office (ICO) recommends a time limit of 20 to 40 working
days to investigate and provide a full response.

Unfortunately, due to an increase in statutory workload, we have not been
able to complete the review within the 20 working day deadline
of 4 October 2017. We therefore need to extend this deadline to the full
40 working days, and calculate the revised deadline for completion to be 1

Thank you I think we are almost there.

I asked you who was providing the assessments. The documentation states it is an "External Occupational Therapist" please specify whom i.e. company/person and there registration number with their respective professional body if applicable.

Secondly there is nothing in the response covering the flow of data between the council and this third party "External Occupational Therapist". From a recent case with LBHF it has become clear that not all third party contractors have the duties and obligations the council has towards citizens, to whom it is primarily responsible for service provision and data protection, included as a matter of course, extended in contract. I would like this information please in this case as it forms part of the process and protocol.

Thank you for your email of 01 November 2017.

We apologise if you feel the internal review response did not include all
of the information which should fall within the scope of your request for
information.

You have asked H&F to provide the following information regarding the
external occupational therapist which you say should have been included in
the internal review response:

(1) "...please specify whom i.e. company/person and there registration

(2) information "...covering the flow of data between the council and this
third party "External Occupational Therapist".   From a recent case with
LBHF it has become clear that not all third party contractors have the
duties and obligations the council has towards citizens, to whom it is

as a matter of course, extended in contract".

There are potentially two options for addressing these concerns.

Option 1 - you could make a complaint to the ICO regarding the internal
review response. (IMT would normally advise a requester to contact the ICO
regarding concerns in respect of an internal review response.)

Option 2 - H&F could process (1) and (2) above as new requests for
information. If you are happy with this approach, we could ask the InTouch
team to log (1) and (2) as new Freedom of Information requests. This may
be a faster way to seek the requested information than going through the
ICO complaints process.

Please advise which option you would prefer to take.
