Dear Croydon Borough Council,

I want to inspect the council's list of Freedom of Information Requests and Outcomes for FOI Requests it has received.

Please provide me with the weblink for this data.

If it is not available on the Council's website, then please explain why.

Please provide a list of all FOI Requests received from 1 Jun 2016 to 1 Dec 2017

This list should be an XLS spreadsheet and should include:
Date of request and date of final response
Subject of Request - a summary of it
Outcome - Information provided, or not available, or already published etc
Summary of each case where the Information was provided.
Note where Internal Review was requested and outcome.
Note where case was referred to ICO, and outcome.

I would note that it would be helpful if full details were maintained on a publicly available website, as one could then search there, and so avoid the possibility of duplicate or overlapping FOI requests.

Freedom of Information Request

 

Thank you for your recent request.

 

Your request is being considered and you will receive a response within
the statutory timescale of 20 working days, subject to the application of
any exemptions. Where consideration is being given to exemptions the 20
working day timescale may be extended to a period considered reasonable
depending on the nature and circumstances of your request. In such cases
you will be notified and, where possible, a revised time-scale will be
indicated. In all cases we shall attempt to deal with your request at the
earliest opportunity.

 

There may be a fee payable for the retrieval, collation and provision of
the information requested where the request exceeds the statutory limit or
where disbursements exceed £450. In such cases you will be informed in
writing and your request will be suspended until we receive payment from
you or your request is modified and/or reduced.

 

Your request may require either full or partial transfer to another public
authority. You will be informed if your request is transferred.

 

If we are unable to provide you with the information requested we will
notify you of this together with the reason(s) why and details of how you
may appeal (if appropriate).

 

Please note that the directorate team may contact you for further
information where we believe that the request is not significantly clear
for us to respond fully.

My Request referred to an 18 month period
" Please provide a list of all FOI Requests received from 1 Jun 2016 to 1 Dec 2017"
The Heading stated "ALL Requests Received, 2016+2017"

However you have only covered 6 months from June to December 2017.
May I please have the full data I asked for?

You reply as below to this.

"Note where case was referred to ICO, and outcome."

"FoIA is only applicable to information held by the public authority in recorded format and we are not expected to provide opinion or speculate in order to answer a FoIA request therefore the Council is unable to provide you with a response in respect of this part of your request.

"In response to the above, we have not previously recorded ICO referrals and in turn do not record the outcomes."

The question asked about cases where the ICO was involved.

Where the ICO has contacted the council by email, there is "information held by the public authority in recorded format".
The question did not ask solely about what information the council chose to specifically record, but what it holds, ie is in its possession.
In addition, when the ICO contacts the council, the council will reply.
There must be records of such emails within the council system.

Please run the appropriate searches and add this data to the spreadsheet.

My FOI was submitted to you and acknowledged the same day

3-1-18
You provided a response that clearly failed to address my Request properly.
This was after taking the full 20 working day maximum period allowed under FOI.

3-1-18
I replied asking you to cover the whole period of 18 months as originally specified rather than the 6 months data you offered.
I also asked again for information regarding ICO involvement.

There has been no reply now for 5 weeks to this.
Please confirm when I may expect a reply, or else that I need to ask for an Internal Review.

I note someone else has written as below.
Sadly this seems to be true in this instance.

Examination of other FOI / EIR on the WDTK website shows that the council appears to routinely delay to the last minute, often beyond it, and then provides limited information or a refusal which could and should have been issued much sooner.
This shows a lack of respect for the FOI / EIR process and and a determination to obstruct it.
