Thank you for your request for information as copied below. 

 

You have asked for a copy of any templates the House of Commons uses for
responding to requests made under the Freedom of Information Act 2000
(FOIA), the Environmental Information Regulations 2004 (EIRs), the GDPR
and the Data Protection Act 2018 (DPA). You have also asked for any
documents, guidance notes or policies the House of Commons uses for
responding to requests, and a copy of any documents held regarding public
interest tests.

 

The Information Rights and Information Security (IRIS) Service of House of
Commons is responsible for dealing with these requests on behalf of the
whole of the House, and we have created a bank of suggested wording
‘templates’ which we use to help us construct our responses to queries,
especially for similar requests we regularly answer. 

 

The information held by the House of Commons relevant to your request can
be found attached.  Please also note the following points:

 

o The ‘templates’ provided are internal working documents which are
regularly reviewed, amended, and updated.
o We do not hold ‘templates’ or policies specific to EIRs.
o We do not hold any specific policies or guidance related to requests
for information made under GDPR/DPA, but we do train House staff to
identify these requests and to forward them to IRIS upon receipt.
o Following the introduction of new legislation earlier this year, our
templates and policies relating to GDPR/DPA are all under review at
present.  These are being updated as required or upon release of
revised guidance from the Information Commissioner’s Office (ICO). 
Therefore, some of the attachments may still reference DPA 1998.
o We do not hold guidance about public interest tests (PITs) because we
follow the guidance found on the ICO website, but some basic PIT
paragraphs which may be helpful for common requests can be found in
the ‘templates’ provided. 
o IRIS manage requests under all the information Acts on a case by case
basis and our templates act as a guide only.  They are adapted as
required to suit the individual circumstances of each case or request.

As this information is reasonably accessible to you otherwise than under
the FOIA, your request is refused. In refusing your request the House is
applying the exemption set out in section 21 (1) and (2) (a) of the FOIA. 
This is an absolute exemption and the public interest test does not apply.

 

 

You may, if dissatisfied with the handling of your request, complain to
the House of Commons. Alternatively, if you are dissatisfied with the
outcome of your request you may ask the House of Commons to conduct an
internal review of any decision regarding your request.  Complaints or
requests for internal review should be addressed to: Information Rights

that you specify the full reasons for your complaint or internal review
