FOI cases handled by R Patel during 19/9/14 to 31/1/15

Response to this request is long overdue. By law, under all circumstances, Home Office should have responded by now (details). You can complain by requesting an internal review.

During the period 19/9/14 to 31/1/15 Rashma Patel handled multiple FOI requests - providing responses to the requests of a number of individuals.

Can you please confirm how many requests she handled / responded to during the above period.

Can you please confirm the home office reference numbers for the requests she handled.

Can you please provide the date the communications were sent by Ms Patel.

Given the very clear request made, and your own department's knowledge of my ongoing court case regarding the SAR handled by Ms Patel, It is not possible for your department to rely on Vexatious to refuse to provide said information.

Your department has relied on a defence under S.13(3) of the DPA 1998 (acting reasonable) to defend your clear delay in responding to a SAR of myself and my wife. Said SAR response clearly failed to disclose information which your department holds (I refer to the internal communication regarding my FOI "Persons Subject to Immigration Control" to begin with - but much more).

The fact of Ms Patel handling various other workloads - despite (by Ms Bastow's own admission) that Ms Patel would not of been able to sift through 21000 pages of information within the prescribed time limit (S.7(8) - " a data controller shall comply with a request under this section promptly and **** in any event **** before the end of the prescribed period beginning with the relevant day." ), the fact that Ms Patel was given additional workload to complete whilst being the sole person responsible for handling our sar's would clearly demonstrate that the HO DID NOT ACT REASONABLY.

I couple that with the misleading comment by Ms Bastow that the department handled 500 SAR's a week. I draw attention to a response by KIMU : https://www.whatdotheyknow.com/request/s...

Only 169 responses were over the 40 calendar days. and in the twelve months prior to our SAR being submitted, there was nowhere near 26000 SAR's handled by the Home Office (please see the response times published by days: https://www.whatdotheyknow.com/request/2... (That wasn't the only misleading comment by Ms Bastow either, was it - but obviously, that's a matter for the courts. She might be interested in this document though: https://www.gov.uk/government/uploads/sy... - Jan 14 - "The UK passport is issued under the Royal Prerogative which is exercised by the Chief
Executive of HM Passport Office *on behalf of the Home Secretary.* ")...

So obviously, as you might wish to argue I'm vexatious. but the case is that a requester cannot be considered vexatious. The merit is of the request itself. And clearly, considering the very real legal implications of this request, the request is clearly with serious merit.

Obviously, having completed your internal complaints procedure, I shall now go to the ICO, which I will be arging that your department has failed on multiple points of the FOIA... and that clearly your department should be responding to this request.
