FOI: Aires, Motorhomes and camping on council land
Dear Highland Council,
Please send me information about the officer/councillors decision making process regarding policy for introducing temporary camping facilities - i.e. water and toilets in wild camping hot spots and aires.
Please send me the council's policy on wild camping, camper vans, caravans and other vehicles over the last five years
I am also looking for a timeline and a breakdown of costs associated with removing no parking signs from lay-bys and establishing aires (costs for cleansing, wardens, barriers etc)
Please can this include any advice given from external bodies such as CAMPRA, Caravan Club and other motorhome associations.

Request for information under Environmental Information (Scotland)
Regulations 2004
The Council considers that the information requested falls within the
definition of Environmental Information as defined by the Environmental
Information (Scotland) Regulations 2004 (EIRs). Such information is
exempt from disclosure under Section 39(2) of FOISA, however the Council
must consider your request under the EIRs. Your request has, therefore,
been treated as a request under the Environmental Information (Scotland)
Regulations 2004. You have the right to ask the Council to review its
decision to apply the EIRs to your request rather than FOISA.

The Council’s policy on wild camping, on its land and elsewhere, is in
line with Land Reform (Scotland) Act 2003 and the associated Scottish
Outdoor Access Code. The National Access Forum guidance is attached. Note
that ‘wild camping’, permitted under access rights is without a vehicle.
The Standard Operating Procedures are the policies carried out by Access
Rangers with regard to ‘wild camping’ and overnight parking. These
documents are also attached.

In relation to No Overnight Parking in Laybys – These signs were removed
many years ago we hold no data on the costs of removal. With reference to
Regulation 10(4)(a) of the EIRs we cannot provide you with this
information as it is not held by The Highland Council.
Please can this include any advice given from external bodies such as
CAMPRA, Caravan Club and other motorhome associations.

Under Regulation 16 of the Environmental Information (Scotland)
Regulations 2004 (EIRs), you have the right to request that the Highland
Council reviews any aspect of how it has dealt with your request. This
requirement for review should be put in writing to the Freedom of
Information Officer, Chief Executive’s Office, Glenurquhart Road,
Inverness IV3 5NX, within 40 working days of receipt of this letter. The
request should include details of the information requested and the
aspects of the Highland Council’s response which you are not satisfied
with.
If you are subsequently dissatisfied with the outcome of the Council's
review, you have the right to appeal to the Scottish Information
Commissioner under Regulation 17 of the EIRS, within six months of
receiving the Council's review response.
