Dear Aberdeen City Council,

I am submitting this Freedom of Information request in response to a previous (FOI) request submitted by a Mr Martin James Keating, referenced - FOI-20-0119.

You received this request on 27th January 2020. I note that the response was late and Aberdeen City Council are conducting an internal review on why this was late.

I invite you to reflect on paragraphs in this response.

"2. How the council would enable protestors engaging in events of a political nature where financial inequality and/or financial issues would be a substantive barrier to the engagement of such rights under the European Convention i.e. Where a financial charge / fee would prevent a person or persons from engaging such rights under the convention."

Your response - All proposed processions are treated equally in terms of the requirements for a TTRO and traffic management plan to be in place prior to the event being approved.

Various funding streams are available, either an application for a grant through the City Event’s Team or applying for funding under the Common
Good Fund.

3. "The differences in any application process between a commercial/entertainment event or parade comparative to an event or
parade which involves the engagement of political protest as protected by the European Convention."

Your response - None. ACC deals with all notifications of proposed processions received in terms of the procedure set out in Part V of the Civic Government
(Scotland) Act 1982, regardless of their nature.

The information requested is as follows;

1.) Can you confirm if Aberdeen City Council provided this information to any applications made to hold a procession, parade or protest of any nature?

i.) If answered Yes. Was this information provided to ALL applications?

2.) Secondly, Can you confirm if Aberdeen City Council have made this information available, without being asked, to any applications made to hold a procession, parade or protest of any nature?

i.) Can you confirm if answered Yes, If this information was provided to ALL applications without being asked?

3.) Finally, Can Aberdeen City Council confirm if this information was made available to any applicants, of whom objected to the costly TTRO costs due to the financial cost?

i.) Can you confirm if answered Yes, that this information was provided to ALL applicants of whom expressed or objected to the costly TTRO costs?

Council (ACC) has completed the necessary search for the information
requested. Our response is now detailed below.

Yes, all applications are assessed on an individual basis, and the
associated costs of both the TTRO and traffic management elements provided
prior to the application being submitted.

 

o If answered Yes. Was this information provided to ALL applications?

Yes, as above, all parades require to be assessed and approved prior to
any application being processed.

 

2.)    Secondly, Can you confirm if Aberdeen City Council have made this
information available, without being asked, to any applications made to
hold a procession, parade or protest of any nature?

Yes, all applicants are advised of the costs associated with any proposed
procession at the initial discussion stage.

 

o Can you confirm if answered Yes, If this information was provided to
ALL applications without being asked?

Yes, all applicants are informed of the costs at the initial discussion
stage.

 

3.)    Finally, Can Aberdeen City Council confirm if this information was
made available to any applicants, of whom objected to the costly TTRO
costs due to the financial cost?

All applicants are advised of the costs of both the TTRO and Traffic
management at the outset in order to ensure that they are fully aware of
the financial implications prior to submitting an application.

 

o Can you confirm if answered Yes, that this information was provided to
ALL applicants of whom expressed or objected to the costly TTRO costs?

Yes.
