Flytipping Cost to the Tax payer

Response to this request is long overdue. By law, under all circumstances, Kirklees Borough Council should have responded by now (details). You can complain by requesting an internal review.

Dear Kirklees Borough Council,

I am writing to submit a formal request under the Freedom of Information Act , seeking information regarding the cost of fly tipping in the whole of Kirkless borough.

I kindly request the following information:

The total cost incurred by Kirkless council in relation to addressing fly tipping for the financial years 2021-2022 and 2022-2023.

Please include a breakdown of the expenses associated with fly tipping cleanup, disposal, enforcement, and any other related costs.
Any reports, studies, or assessments conducted by Kirkless borough council that detail the economic impact of fly tipping, including the cost borne by local communities, businesses, and the environment.
If any evaluations have been performed to determine the financial burden caused by fly tipping, please provide the findings and associated documentation.
Information regarding the strategies, initiatives, or programs implemented by Kirkless to prevent and reduce the occurrence of fly tipping. This may include educational campaigns, community engagement efforts, enforcement measures, or partnerships with relevant stakeholders.
Any statistics, records, or data sets maintained by Kirkless that outline the number of reported fly tipping incidents, locations affected, and associated costs over the requested periods
Any available information regarding successful prosecutions, penalties imposed, or legal actions taken against individuals or organizations involved in fly tipping within the jurisdiction of Kirkless

Thank you for your request dated 28 July 2023 and I regret to inform you that the Council considers the name "Only Mee" to be a pseudonym and not a real name for the purposes of Section 8(1) of the Freedom of Information Act 2000.

Section 8(1) of the FOIA sets out the requirements of a valid request for information and says that a request must, amongst other things, "state the name of the applicant and an address for correspondence". The ICO has issued guidance on what is an acceptable name and states that the use of the phrase "the name of the applicant" in section 8(1) (b) indicates that the real name of the applicant should be used when requesting information.

See the ICO’s guidance document Recognising a Request made under the FoI Act (Section 8) paragraphs 14 onwards, particularly paragraph 25. In order for your request to comply with this requirement, I would be grateful if you could provide your real name.

The Information Commissioner considers that a relatively informal approach is appropriate and therefore title and or first name with a surname satisfies the requirement for provision of a real name, as does the use by a female applicant of her maiden name. The prime consideration is whether enough of a person's full name has been provided to give a reasonable indication of that person's identity.

In the circumstances and, in order that I can process your request, can you please provide me with your real name.
