Fly Tipping and CCTV
Dear North Lanarkshire Council,
There are a number of sites in North Lanarkshire which have trouble with regular fly tipping. A number of these have had signs erected informing people that CCTV is in use, to detect people carrying out fly tipping. Could you please answer the following?
1) Please list any site which has had these signs erected.
2) Of the sites where the signs have been erected, how many have actually had an operating CCTV system fitted?
3) How many prosecutions were made on the basis of evidence gathered by CCTV?
4) How many of these prosecutions were successful?
Some parts of this request may be easier to answer than others, and should this prove to be the case I would ask that you release available data as soon as possible rather than hold up the entire request.

Request for Information
I refer again to your e-mail of 27 January 2011 seeking information in
relation to CCTV used specifically to detect incidents of fly tipping.
Having investigated, my response to your queries numbered 1-4 is as
follows:-
(1) &
(2) I regret to advise you that the information sought is exempt in
terms of Section 35(1)(a) of the Freedom of Information (Scotland) Act
2002 in that disclosure would, or would be likely to, prejudice
substantially the prevention or detection of crime and in all the
circumstances of the case it has been concluded that the public interest
in disclosing the information is outweighed by that in maintaining the
exemption.
(3) In the financial year 2009/2010 no prosecutions were made on
the basis of evidence secured by CCTV. However, to be of assistance I can
advise that in financial year 2009/2010, 140 fixed penalty notices were
served for fly tipping.
(4) N/A.
I can advise that North Lanarkshire Council, having regard to the
provisions of Section 21 of the Freedom of Information (Scotland) Act
2002, has established a procedure whereby any person who has requested
information and is in any way dissatisfied with the decision on that
request, can require a review of that decision by writing to the Executive
Director of Corporate Services, Civic Centre, Windmillhill Street,
Motherwell ML1 1AB. Accordingly, if you are dissatisfied with this
decision and seek such review please write to the Executive Director of
Corporate Services.
I would advise, also, that in terms of Section 47 of the Act a person who
is dissatisfied with a notice given by the local authority under Section
21 of the Act - ie. a notice following a review of a decision by a local
authority, or by the failure of a local authority to give such a notice -
may make application to the Scottish Information Commissioner for a
decision as to whether, in any respect specified in that application, the
request for information to which the requirement relates has been dealt
with in accordance with the Act. Such an application must be in writing
or in another form which, by reason of it having some permanency is
capable of being used for subsequent reference - for example a recording
made in audio or video tape - must state the name of the applicant and an
address for correspondence and must specify the request for information to
which the requirement for review relates, the matter which gave rise to
the applicant’s dissatisfaction with the original decision of the local
authority and the matter which gives rise to the applicant’s
dissatisfaction with the decision on review by the local authority or the
failure of the local authority to issue such a decision. The Scottish

I refer to your e-mails of 25 February and 9 March 2011 relative to your
request for information on the detection of fly tippers.
Having investigated, my response to your numbered paragraphs is as
follows:-
1. Yes. Mobile CCTV cameras are erected specifically for the purpose of
detecting fly tippers.
2. Information on how much this has cost in the financial year 2009/10 is
not held, and in terms of Section 17 of the Freedom of Information ()
Act 2002 I must advise you of this. By way of some explanation, the
time spend deploying cameras and reviewing the footage by the
Environmental Protection Officers is not recorded. Furthermore, this
activity is a proportion of their overall work.
3. I attach a spreadsheet setting out the sites fly tipped over the
period 2009/2010.
I can advise that North Lanarkshire Council, having regard to the
