Please treat this request for information as a Freedom of
Information request in accordance with the Freedom of Information
(Scotland) Act 2002
I request the following information from Scottish Borders Council:
For each month of 2008 and from January 2009 to July 2009 I would like to know the number of fines issued by Scottish Borders Council in relation to flyposting. I would like this information broken down by month and area of offence (either by ward or committee area).
For each month of 2008 and from January 2009 to July 2009 I would like to know the number of written warnings issued by Scottish Borders Council in relation to flyposting offences. I would like this information broken down by month and area of offence (either by ward or committee area).
For each month of 2008 and from January 2009 to July 2009 I would like to know the number of verbal warnings issued by Scottish Borders Council in relation to flyposting offences. I would like this information broken down by month and area of offence (either by ward or committee area).
For each month of 2008 and from January 2009 to July 2009 I would like to know the number reports made to the Procurator Fiscal by Scottish Borders Council in relation to flyposting offences. I would like this information broken down by month and area of offence (either by ward or committee area).

Further to your request for information under the Freedom of Information
(Scotland) Act 2002 relating to the above I am now able to respond.
I can advise that Scottish Borders Council only deal with the removal of
fly posting and incidents are reported to the Police as this is classified
as vandalism. As to the issuing of the fines this would be done by the
Police. The Council does not hold any information on fines in relation to
fly posting and this is therefore exempt under Section 17 of FOISA. As
the information is available from the Police it is also exempt under
Section 25 of FOISA as the information is otherwise accessible.
I have to advise that if you are not happy with the Council's response
then you have a right to request a review within 40 working days of
receipt of this e-mail. You should either e-mail
