·         When you refer to information on the flood risk assessment – do
you mean the data used to inform assessments for these areas ?.   Or is it
the actual flood risk assessment reports used to help inform planning
applications ?

 

·         What information on flood mitigation information are you wanting
?.  Is this just information on the current defences in these areas ?

 

·         What other documentation are you referring to ?.   This is too
general and we need specifics.

Request for information under the Freedom of Information Act 2000 (FOIA) /
Environmental Information Regulations 2004 (EIR)

Thank you for your email request of 11 November 2018 clarifying your email
of 05 November 2018 and for your additional emails of 24 November 2018
which appear to be duplicate requests of your 11 November 2018 email.

 

You requested the following information:

 

1. all recommendations that the Environment Agency made to Calderdale

Requests for information that is recorded are generally governed by the
Freedom of Information Act 2000 (FOIA).The information you have requested
is environmental and it is therefore exempted from the provisions of FOIA
by FOIA s.39(1). We have therefore considered your request under the
provisions of the Environmental Information Regulations 2004 (EIR). EIR
regulation 12 allows a public authority to refuse to disclose
environmental information if an exception to disclosure applies under
paragraphs (4) or (5) and in all the circumstances of the case, the public
interest in maintaining the exception outweighs the public interest in
disclosing the information. A public authority shall apply a presumption
in favour of disclosure.
