Dear Scottish Borders Council,
The Local Authority is requested to provide a list of motor vehicles operated by the council (owned or leased) currently licensed with the Driver & Vehicle Licensing Authority (“the DVLA”). Please include the following details.
1. Registration Mark of each motor vehicle;
2. Fleet number allocated (if any);
3. Chassis Make and Model;
4. Type of Body fitted;
5. Date new or date of acquisition.

The above request is exempt under S39(2) Environmental Information of
FOISA therefore we respond under the Environmental Information (Scotland)
Regulations 2004.
The following response was prepared and provided on behalf of Assets &
Infrastructure:
Please find our response attached with the exception of registration
numbers.
The registration numbers have been withheld to prevent possible future
crimes occurring. It is the Council's opinion that disclosure of the
registration of Council vehicles into the public domain could potentially
benefit persons wishing to commit a crime.
A request for vehicle registrations, together with the other information
requested (fleet number, department and make of vehicle) provides bogus
workmen or persons intent on some form of illegal activity with specific
internal information into the Council's operations that could be used for
some illegal purpose, such as vehicle cloning. Vehicle cloning would
include using the information requested to disguise the identity of a
vehicle by means of false number plates. The use of false number plates is
a common method used by criminals.
The Council has experienced cloning of vehicles in the past and is
therefore eager to prevent it reoccurring whenever possible. Further if a
Council vehicle is cloned and used in a crime, the release of the
requested information makes it difficult for the Council to prove that
they or a member of staff was not involved in the criminal activity.
The Council, in considering the public interest test, has concluded that
the public interest weighs in favour of withholding the registration
numbers, since the benefit of crime prevention outweighs any benefit to
the public in providing the information sought and is therefore relying on
10(5)(b) of EI(S)R 2004.

working days from the date we respond to your request. You should either
