Our Response

 

Your request for information has been considered under the Freedom of
Information Act 2000 I can confirm that Hertfordshire County Council does
hold the information you have requested, and can respond as follows:-

However, following careful consideration we are withholding the
information regarding callsigns (question 5). The Council considers that
this falls within the exemption contained in Section 31(a) of the Freedom
of Information Act 2000 which exempts information from disclosure on the
grounds of prejudice to the prevention or detection of crime.

 

This exemption is qualified, which means that in reaching this decision,
the County Council has balanced the public interest test in withholding
the information against the public interest in disclosing the
information. 

 

The factors we have considered, which are in favour of disclosing the
information, are:

* Disclosure may contribute to the accountability and transparency of the
County Council with regard to the management of its services
* Disclosure may be of value to commercial organisations doing business
with the Council

 

The factors we have considered which are against disclosure are:

* The Council is concerned to maintain a secure communications network,
particularly when dealing with threats to the public.  Providing this
data may prejudice the security of the Community Protection Service and
the vehicles it uses.
* The County Council has a responsibility to secure the protection of all
residents and visitors to the County, and to maintain and protect the
property of all council tax payers of Hertfordshire
* There is a strong public interest in the efficient use of public and
police resources.

 

On balance the County Council believes that the public interest in
withholding callsign data outweighs the public interest in disclosing this
information.
