FREEDOM OF INFORMATION ACT 2000 (FOIA) – REQUEST FOR INFORMATION

The City of London (CoL), sometimes also called the City of London Corporation, acknowledges receipt of your request for information of 22 July 2017, addressed to the Common Council of the City of London. We note that it is identical to the request sent by you on 5 July 2017 addressed to City of London Corporation, and which became valid with effect from 18 July 2017 following your clarification of 17 July.

Please note that, although the WDTK site lists the CoL at two places –

- where your identical requests are listed, the CoL is in fact only one legal entity. The CoL has informed the WDTK website of this and explained that it would be less confusing for applicants if the site referred to the CoL under one name instead of maintaining two lists and two names for the same legal entity, but it has declined to make the change. For further clarification of the position of the CoL under the FOIA, please see Paragraph 9 of Schedule 1 of the FOIA, which describes the CoL as being subject to the FOIA with regard to 'The Common Council of the City of London, in respect of information held in its capacity as a local authority, police authority or port health authority'.

Public authorities are required to respond to requests within the statutory timescale of 20 working days beginning from the first working day after they receive a request. The Act does not always require public authorities to disclose the information which they hold.

The FOIA applies to the CoL as a local authority, police authority and port health authority. The CoL is the local and police authority for the “Square Mile”, ie the historic City of London, and not for London as a whole. of 17 July 2017, and our acknowledgement of the same date, the City of
London (CoL) responds as follows.

 

We note that you have also sent a repeat (identical) request of 22 July
2017. This is refused  under section 14(2) of the FOIA, ‘Repeat requests’.

Please note, the CoL is not solely a local authority; it has charitable
and other related functions as well as public ones. As a result, the work
of the CoL is funded from one of three sources which it controls.

o one is the City Fund (a public, tax-based fund);
o another is City’s Cash (a combination of funds including endowments
which have been built up over the centuries);
o and the third is charities funding, primarily the Bridge House Estates
Fund.

Only City Fund activities, i.e. its functions as a local authority, police
authority and port health authority, fall within scope of the Freedom of
Information Act (FOIA). 

 

The CoL confirms that the information requested falls under the remit of
both City Fund and City’s Cash. Therefore only information pertaining to
the CoL’s function as a local authority has been provided.  

 

Please note that the CoL is the Local Authority for the "square mile"
only, i.e. the historic City of London, and not London as a whole, which
is covered by over 30 boroughs and the Westminster City Council. Please
