Fixed Penalty Notices for Litter and Fly-tipping

Dear Crown Office and Procurator Fiscal (Scotland),

Over the least three financial years I understand that at least 756 unpaid fixed penalty notices for litter were referred to the procurator fiscal by local authorities. I understand that at least unpaid 140 fixed penalty notices for fly-tipping were also referred to the procurator fiscal too.

Please could you confirm what action was subsequently taken?

In particular I would like to know:

1. For both types of FPN, how many people were issued with fines, and the average value?
2. How many fines were subsequently paid?
3. How many cases did the procurator fiscal choose to take no further action on?

Dear Crown Office and Procurator Fiscal (Scotland),

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of the Crown Office and Procurator Fiscal (Scotland)'s handling of two of my FOI requests. You gave them refs: R019657 and R019713

In both cases the requests did not elicit any useful information, despite making clear that COPFS do hold some information relevant to the request. Despite guidance from the Scottish Information Commissioner that suggests that FOI officers should assist requesters in narrowing their request this did not happen at the start of the process.

The response given to the above requests said: "From our database we can extract charges (such as littering) that are reported to COPFS by a Local Authority and the subsequent actions taken e.g. Direct Measure/No Action etc. We cannot identify whether the Local Authority had already issued a Fixed Penalty that was unpaid and are therefore unable to provide any data for this request."

I now understand that you cannot tell whether these referrals relate to an unpaid FPN or not. Nevertheless, I'd be grateful if you could supply details of any littering charges that have been reported to COPFS and the outcome, broken down by local authority, or Scottish public agency, and year, over the timescale previously specified.
