Dear Environment Agency,

I was invited to witness your joint exercise with Essex Police carried out from the Wennington bridge over the A13 in Essex on 13th September 2016.

Commercial vehicles were being directed onto the bridge for inspection checks. I understand the EA have powers to issue fixed penalty notices where certain offences have been committed.

Can you please provided me with a list showing what actions were taken by the EA officers present including details of any fixed penalty notices issued.

Please include all of the information you log in these cases including the relevant legislation being applied, the type of vehicle, what they were doing wrong and the amount of the fine.

Enquiry: Fixed penalty notices - A13 - 13th September 2016.

Thank you for your enquiry which was received on 21 October 2016

We respond to requests under the Freedom of Information Act 2000 and the Environmental Information Regulations 2004.

In response to your questions:

The Environment Agency stopped 26 vehicles on the day and these were provided with advice and guidance. Further follow up work including letters to 18 operators detailing the requirements of the legislation is planned. No fixed penalty notices were issued.

8 vehicles were not carrying waste.

The relevant legislation being applied in cases where waste was being carried without the benefit of a Carriers registration where required is the Control of Pollution (Amendment) Act 1989, Section 1(1) carrying of waste whilst unregistered. 5 vehicles fell into this category. These were provided with advice and guidance.

The 5 vehicles types were 2 transit style flatbed lorries, 2 trucks and a van.

The relevant legislation being applied where the Documentation accompanying the waste movement was checked is the Environmental Protection Act 1990 and where it was found to be incomplete sections 34 (5) and 34 (6) Failure to incorporate certain specified information on a transfer note or failure to make or retain transfer notes. 15 vehicles fell into this category.

These vehicles included:

6 25 tonne Tipper truck
7 transit style flatbed lorries.
2 vans

All were provided with advice and guidance.

There were no fines to report.
