Dear Leeds City Council,

Could you provide the statistics (listed 1-9) below for all Fixed Penalty Notices issued for the below offences (listed 10-22)? Could you provide these statistics for the financial years of 2015/16, 2016/17 & 2017/18? Could the stats be provided in an excel table format?

4. Can you confirm the name of each council department that has the power to enforce the above legislation?

5. Is the enforcement of the above Fixed Penalty Notices carried out by the council or a contractor?

6. If the answer to the above question is a contractor, could you answer the following questions

• Name of contractor
• Is the contract a pilot or procured contract
• Contract start date
• Contracts end date

Request: Fixed penalty notices

 

I write in response to your above Freedom of Information request, received
in this office on 3 April 2018.

 

In dealing with your request, please note that we have considered it under
the Environmental Information Regulations 2004, as opposed to under the
Freedom of Information Act 2000. This is because the information you have
requested is information involving ‘activities’ and ‘administrative
measures’ which are likely to affect elements of the environment under Reg
2(1)(c).  I am advised that both the domestic and European courts give
wide meaning to the Regulations and have indicated that they will adopt a
broad construction of the definition of environmental information.

Your request asked:

To retrieve the data would require a significant amount of time and
resource. Therefore, given the extent of the information you are looking
for, we are applying Regulation 12(4)(b) as we believe that this part of
the request is ‘manifestly unreasonable’ because providing the information
you have requested would impose unreasonable costs on us and require an
unreasonable diversion of resources.   Although there is no specific time
and cost limit provided for under the EIR 2004, under section 12 of the
FOI Act we are not obliged to comply with a request if we estimate that
the cost of determining whether we hold the information, locating and
retrieving it and extracting it from other information would exceed the
appropriate limit of £450 set by the Freedom of Information (Appropriate
Limit and Fees Regulations 2004).  This is calculated at £25 per hour for
every hour spent on the activities described. We are applying this concept
to your request under EIR given the particular voluminous nature of your
request and the burden.

1.            How many full-time officers council/contractor enforce the
above-listed offences?

There are currently 28 Environmental Action Officers employed by the
council in the East, West & South teams.  We currently have 4 vacancies.

3GS (our contractor) had 4 full time officers between 2015 and 2017 and 6
officers from 2017 to present. Within the City Centre there is also one
Senior Environmental Action Officer to cover the other FPN offences not
handled by 3GS.

 

2.            How many hours do these hours spend patrolling the borough
per year (could you break this down into each offence category numbered
1-9 above)?

The 3GS officers work a 40 hour week patrolling the City centre.  We are
unable to provide this information in relation to Leeds City Council staff
as we do not record the work as ‘patrols’.

 

3.            Can you confirm your council has the powers to enforce the
above the legislation. If not, can you confirm which legislation the
council has the power to enforce?
Yes, the delegation for enforcement lists Environmental Action Officers,
Senior Team Leaders, Team Leaders, Service Managers and the Head Of
Service

 

4.            Can you confirm the name of each council department that has
the power to enforce the above legislation?
Cleaner Neighbourhoods Team  

 

5.            Is the enforcement of the above Fixed Penalty Notices
carried out by the council or a contractor?
The enforcement of the list of fixed penalties is carried out by the
council.  In addition, for littering only in City Centre, a  contractor is
used

 

6.            If the answer to the above question is a contractor, could
you answer the following questions

 

•             Name of contractor – 3GS Ltd

•             Is the contract a pilot or procured contract - Procured

•             Contract start date - 2015

•             Contracts end date – Jan 2019

 

7.            If the answer to question 6 is a contractor, what is the
total amount of invoices paid to the contractor for 2015/16, 2016/17 and
2017/18 financial years? Broken down into the specified years?

 

2015/16 - £209,680

2016/17 – £141,133,

2017/18 - £118, 792

you are entitled to make representations to us if it appears that we have
failed to comply with a requirement of the Regulations in relation to your
request. Representations must be made to us no later than 40 working days
after the date you believe we failed to comply with such a requirement.

decide if we have complied, notifying you of our decision as soon as
possible, and no later than 40 working days after the date of receipt of
your representations.

 

Under Regulation 18, you are then entitled to apply to the Information
Commissioner for a decision as to whether, in any specified respect, your
request has not been dealt with in accordance with parts 2 and 3 of the
Regulations.
