1) The number of tickets/cases initiated by a fixed traffic enforcement camera, per camera within Kent & Medway

2) The number of these which have been appealed to court

3) The number of these which were "lost" by Kent Police at court or where no further action was taken

I am writing to request an internal review of Kent Police's handling of my FOI request 'Fixed Camera Statistics'.

I understand you are claiming exemption on grounds of health and safety and possibility to prejudice prevention or detection of crime.

I believe that, especially given the recent press regarding Safety Cameras, the public have the right to information held about their use.

You argue that the fact some cameras are not always in use will allow people to work out which cameras are not always active and therefore possibly increase the number of offences occurring within those areas.

I wish to argue that the statistics alone should not reveal which cameras are not in constant use, nor when cameras are not in use. Indeed this could regularly change and would not be able to provide useful information.

Instead I would argue it is in the public's interest to see this information, as ultimately it is our money funding the upkeep of these cameras and if they are not achieving sufficient results then their use can be questioned.

In order to argue positively or negatively for each camera sight I feel it is relevant to see full information for each site.

For this reason I am requesting an internal review on the basis that this information is in the public interest to be disclosed and look forward to your response regarding these issues.

Where a Welsh authority has provided details of camera statistics I wish to further challenge your view that you are unable to provide the requested information.

Obviously the Welsh authority has decided that this will not affect their effectiveness, going as far as to provide sufficient details for a map to be produced showing the effective rate of speed cameras.

Therefore I wish to reopen this request.

The government's transparency agenda requires information regarding safety
cameras to be disclosed routinely. ACPO has agreed that forces will
publish offence information at force level and on a site by site basis.
ACPO has requested that forces publish data commencing with figures for
2010. Data for Kent will be published shortly on the Kent & Medway Safety
Partnership website ([1]www.kmscp.org).
 
The data to be published by forces will be:

 1. The annual number of prosecutions arising from each permanent or long
term temporary fixed camera site in their area. (Long term is defined
as those in place in excess of six months).  This single figure should
include the total number of offenders dealt with either by summons,
fixed penalty or NDORS courses;
 2. The annual total of offences recorded by each force resulting from
camera enforcement across their entire area, and the disposal methods
for each (NDORS, Fixed Penalty, or Summons).

It is clear therefore that the position of Kent Police has changed since
dealing with your request. I note that you wish to re-open your request.
This may not be practical for 2 reasons: first, we have already conducted
an internal review and under the Act this should be appealed to the
Information Commissioner rather than to the public authority; second, any
such appeal would deal with matters as at the date of your original
request rather than as they stand currently.
 
In the circumstances, we are happy to provide the information specified
above for the years 2008, 2009 and 2010, the period originally requested.
For the avoidance of doubt, we will process this as a fresh request to
enable you to exercise your rights under the Act. The reference number
allocated is FOI 11/09/121.
