Dear Wirral Metropolitan Borough Council,

It has now been more than 20 working days since my original inquiry (regarding First Tier Tribunal: Special Educational Needs and Disability). The FOI Act requires a response within this timeframe; the Information Commissioner also advises that FOI requests are deal with in 20 working days or less. Please could I have an update on how my request is progressing?

Yours faithfully,

Michael Gaffney

Dear Mr Gaffney,

Thank you for your recent email.

Your FOI was due yesterday, unfortunately on this occasion we were unable to meet the deadline & for this I sincerely apologise for this delay.

I did chase the relevant department this morning & we are currently waiting for a response to Q3 of your request.

If you wish, I am in a position to disclose our responses for Questions 1 & 2. I will then return to you once we have received the final response for part 3 of your request?

Please advise.

Yours sincerely,

Dear Chelsea,

Thank you for getting back to me so quickly, I really appreciate it.

If you could disclose the responses to Questions 1 & 2 now, and then get back to me once the answer to Question 3 is ready, that would be brilliant.

Thank you for the suggestion, and for your flexibility.

Yours sincerely,

Michael Gaffney

Dear Mr Gaffney,

I write to you in respect of the outstanding part of your recently
submitted Freedom of Information Request.

Please find attached.

Officers conducting the response to this part of the request can advise
that the Council's external spend, (Counsel's fees), for the Financial
period (April) 2018 to (March) 2019 is £11,130.

For the period 2019 to 2020 to date, it is £17,748 but that there are a
number of fees that still require settling during this latter period so it
is not a fixed figure.

For the period prior to this namely 2017 to 2018 and prior to this even
there was a different Spend Code and that a number of invoices were
charged to the Code which makes it extremely difficult to determine the
exact SEND spend emanating from it.

I trust the above assists you with your enquiries.

You have the right under Section 17 of the Freedom of Information Act 2000
to ask for an internal review of the refusal of the information
requested.  Please direct any request for an internal review to
[1][Wirral Borough Council request email] and your request will be allocated for
review.

If you are dissatisfied with the outcome of an internal review you also
have the right to complain to the information Commissioner,
