First Greater Western Limited - regulated fares Off-Peak dispensations

Dear Sir / Madam,

I am writing to make a request under the Freedom of Information Act 2000.

I understand that the Department's franchise agreement with train operator First Greater Western Limited (trading as GWR) includes provisions as to the regulation of fares (https://assets.publishing.service.gov.uk... page 81). In a previous Freedom of Information request (https://www.whatdotheyknow.com/request/r...) the Department provided a response which indicates that many Off-Peak/Saver Return fares from former Network SouthEast stations (e.g. Reading) to London priced by GWR, are considered regulated fares.

It has come to my attention that GWR have introduced additional evening peak restrictions on some of these fares, e.g. for Reading Station to London Terminals (http://www.brfares.com/#faredetail?orig=...), applying as of the new timetable commencing in mid-December 2019. Some of these restrictions extend beyond 19:00 in the direction away from London (this is not explicitly detailed in the human-readable restrictions but is detailed in the electronic restrictions used by journey planners and ticketing websites).

As per the above franchise agreement, I understand 19:00 to be the latest time that such restrictions may extend to for a regulated Off-Peak/Saver Return fare. I would therefore like to ask for a copy of any documents or correspondence involving the Department discussing and/or granting a dispensation from GWR complying with the requirements of fares regulation in the case of the above (and other similar) fares, or any other documents or correspondence relating to any other explanation for this apparent non-conformity.

I would be happy to confirm any further details required to identify the information sought.

Thank you for your response.

You have referenced correspondence between the Department and Great Western Railway in relation to this matter, but you have not included a copy of it as requested in my original request.

I would be grateful if you could therefore provide me with a copy of the correspondence as requested, and in particular any correspondence which details the measures which Great Western railway intends to take (or which the Department instructed it to take) to compensate or reimburse passengers who were wrongly offered Anytime instead of Off-Peak fares.
