Re: Your request for information


Thank you for your request for information submitted via the
Whatdotheyknow website on 2^nd July 2018.


As you may be aware, under the Environmental Information Regulations 2004
(EIR), we are only obliged to provide you with “environmental”
information, which we hold. This is defined under Regulation 2 of EIR.


We recognise that there is a human health element to your request.
However, unfortunately by reference to the definition, we are unable to
conclude that information appertaining to the numbers of staff employed,
the numbers trained in First Aid, who any training providers are, nor the
amount spent, could be viewed as environmental information about elements
of the environment nor factors affecting them, or even any measures about
those elements/factors.


We therefore regret having to advise that as your request does not fall
within the definition of environmental information, there is no obligation
under EIR Regulation 5 to provide you with it.


Although we are not of the view that your enquiry was a request for
environmental information, should you consider that that we have not
adequately complied with our obligations under EIR, you have the right to
ask us to carry out an internal review, by writing to David Hannon Head of
Legal, United Utilities, Legal Department, Grasmere House First Floor,
Lingley Mere Business Park, Lingley Green Avenue, Great Sankey,
Warrington, WA5 3LP. Alternatively, you may find it easier to e-mail us
directly on [1][United Utilities request email] and your review request will be
forwarded on to Mr Hannon.


Your request for review should explain why you wish a review to be carried
out, and should be made within 40 working days of receipt of this letter,
and we will reply within 40 working days of receipt. If you are not
satisfied with the result of the review, you then have the right to make a
formal complaint to the Information Commissioner.

Dear Jain, Rajat,

Many thanks for your reply. I wasn't aware of the Environmental Information Regulations 2004 and the restriction. Thank you for your reply and thank you for the explanation. I would like to note that although you have no reason to provide it, I don't fully understand why you wouldn't want to and what harm it would do if you did provide it.. however I do appricaite the rules and again I thank you for your reply.
