Thank you for your correspondence, received 4^th June 2019 where you
requested West Midlands Police to review its response to your request for
information reference number 009711/19

 

REQUEST

In relation to FOI 009711/19, You requested that West Midlands Police
provide information on

 1. Whether figures provided from a web-link about highways were true
 2. What was being done about it
 3. How many ignitions are caused by discarded items
 4. How many fluid-spills are caused by discarded items.

West Midlands Police responded that the information was not held by them,
and suggested that you may wish to contact Highways England for further
information.

 

You have now submitted correspondence, that as it is titled `Internal
review of Freedom of Information request` indicates that you require a
review of the response provided to you under reference 009711/19, however,
you have not included any narrative to support this. And have also
submitted two additional questions

 1. What criteria do you hold for such incidents
 2. Why are you unable to provide information about notification and
attendance

 

RESPONSE

Please be advised that I have reviewed the original disclosure and can
advise that response provided was correct. You should note that the FOI
Act only extends to requests for recorded information held by the
receiving authority.  It does not require public authorities to answer
questions generally and does not extend to requests for information
generated or held by other authorities/agencies - unless the answer to any
such request is already held in recorded form by the receiving authority.

In this case the force did not hold recorded information as to whether
figures you provided via a web -link were true, or what was being done
about this. Specific recorded information is also not held in relation to
how many ignitions and fluid spills are caused on highways by discarded
items. Therefore the force maintains that the disclosure made under
reference 009711/19 is upheld.

 

In relation to the additional questions submitted on 4^th June 2019, as
these did not form part of your original request they have not been
included in this internal review. Should you wish to submit these as part
of a new request please contact us again and also clarify what specific
recorded information it is that you are requesting.

 

If you are not content with the outcome of the internal review, you have
the right to apply directly to the Information Commissioner for a
decision. The Information Commissioner can be contacted at: Information

REPLY: Please be advised that this is not a valid Freedom of information
Act request as it does not fulfil Section 8 of the Act. It is not a
request for specific recorded information. You have not specified what
your request relates to.

In addition, the authority does not have to answer requests if this would
mean creating new information or giving an opinion or judgement that is
not already recorded.

 

This acts as a refusal notice for this request.

 

As previously advised, should you wish to submit a FOI request you will
need to clarify what specific recorded information it is that you are
requesting and also, if appropriate, what time parameters the request
covers.

 

Should you wish to proceed with the above request – in relation to
question 1 please clarify what `incidents` you refer to and what
`criteria` you refer to. In relation to question 2, please be advised that
