Fines imposed on National Highways for Late Roadwork Completion
Dear Office of Rail and Road,
I write to you under the Freedom of Information Act 2000 to request information as to the amount of money (if any) the ORR fined National Highways for the late completion of the Marks Tey to Stanway resurfacing project in Essex.
The project was estimated to finish between late 2023 and early 2024 but was only completed in October 2024.
I write to request the following information:
- Was National Highways fined for completing the Marks Tey to Stanway resurfacing scheme late
- If so, what was the amount of the fine and why specifically was it imposed
- What is the threshold for the ORR fining National Highways
- Which projects have National Highways been fined for so far in 2024
- What is the total amount of money National Highways has been fined for in 2024
- If no fine has been issued, is a fine being considered for National Highways after the Marks Tey to Stanway scheme was delivered late and overbudget

We have considered your request under the terms of the Freedom of
Information Act 2000, and our response is as follows.
• Was National Highways fined for completing the Marks Tey to Stanway
resurfacing scheme late?
No
• If so, what was the amount of the fine and why specifically was it
imposed?

Our approach to enforcement is set out in chapter 6 of our [1]holding
to account policy. We must also have regard to the [2]statutory
guidance issued to us by the Treasury and the Department for
Transport.
• Which projects have National Highways been fined for so far in 2024?
None
• What is the total amount of money National Highways has been fined for
in 2024?
N/A
• If no fine has been issued, is a fine being considered for National
Highways after the Marks Tey to Stanway scheme was delivered late and
overbudget?
We are not considering issuing a fine regarding this scheme. As a general
principle, we focus our resources and priorities on sustained failure to
deliver outputs, or on individual events of national significance. We will
however consider where failures may form part of a wider systemic failure
and consider action where appropriate. This approach is set out in our
