I understand that in 2014 you, as a Trust, undertook a survey of staff's experience of bullying within the Trust. this was in addition to the National work that was under way.

Please provide the findings of the Trust specific work into bullying in the Trust and any report that pertains to the findings.

I am writing to request an internal review of London Ambulance Service NHS Trust's handling of my FOI request 'Findings of the Bullying Review'.

It is my opinion that on two counts a review needs to be undertaken:

1 - As per FS50211630that cites that the exemption not to release information was not applied correctly as the public authority did not have an intention to publish the information within a reasonable period from the date of the request. It has been over 1 month now since the request was made and in excess of 4 months since the report was compiled. In order to remain current the report needs to be in the public domain for review.

2 - it is a honestly belief that, the public interest in disclosing this information outweighs the public interest in maintaining the exemption, particularly with regards to the reports relationship to the recent NHS Staff Survey results which highlighted poor morale and also in relation to the on-going reported exodus of staff leaving and the on-going poor performance of the trust.

Overall, taking both points into consideration, it is believed that the use of an exemption fails the application of the Section 22 Public Interest Test

Request for No-Executive Director Review of Foi request

Further to your letter dated the 5th may 2015 using a S.22 exemption "insofar as it is the intention of the LAS to publish this report at a future date". Although I understand you rationale for invoking the S.22 exemption, there has been precedent set as per FS50211630 (and others) that although there was an intention to publish, the intention was not within a reasonable timeframe.

The timeframe on this occasion is an important factor in the disclosure of this information as the findings could be closely related to the findings of the NHS Staff Survey (highlighting poor morale), the current performance issues, the continued exodus of staff and also the placement of senior managers with your restructure. To continue to delay the release of this sensitive material, continues to mask from the pubic the internal issues surrounding on-going problems experienced by the Trust - a publicly funded and accountable organisation.

I accept that, some material requires verification, but as I understand it this is now 5 months after the survey was completed, which I would suggest is a more than reasonable time frame to seek these clarifications and I would also ask what the Trust feels is a reasonable timescale for the release of this document.

I look forward to response from your panel of Non-Executive Directors.
