Central Hill Estate reference:14/124 Central Hill Version 5 dated
6thjuly2016. Please see attached. The document is the redacted version
that was provided to the Resident Engagement Panel on 30 August 2016.
I can confirm that Lambeth Council holds the information you requested.
This element of your request for information has now been considered and
unfortunately, it is not possible to meet your request. Some information
on the proposed redevelopment option has been redacted due to the
commercial sensitivity of the costs to the scheme.
In accordance with Section 17 of the Freedom of Information Act 2000, this
letter acts as a Partial Refusal Notice. The information is being withheld
because the following exemption applies.
s43 (Prejudice Commercial Interests)
Section 43 of the Freedom of Information Act 2000 sets out an exemption
from the right to know if:
(1) A trade secret
(2) Disclosure would or would be likely to prejudice the commercial
interests of any person (A person may be an individual, a company, the
public authority itself or any other legal entity). This is also a
qualified exemption.
Section 43 (2) Information is exempt information if its disclosure under
this Act would, or would be likely to, prejudice the commercial interests
of any person (including the public authority holding it).
This is a qualified exemption under the Freedom of Information Act 2000
which means that consideration must also be given to whether in all the
circumstances of the case the public interest favouring disclosure is
greater than the public interest in maintaining the exemption.
The public interest means what is in the best interests of the public not
what is of interest to the public.
Public interest test considerations
In applying this exemption, we have had to balance the public interest in
withholding the information against the interest in favour of disclosure.
Factors in favour of disclosure
· Furthering the understanding, and participation in the public
debate of issues.
· Facilitate the accountability and transparency of public
authorities for decisions taken.
· Facilitate accountability and transparency in the spending of
public money.
· Allow individuals to understand decisions made by public
authorities affecting their lives and, in some cases, assist individuals
in challenging those decisions.
Factors in favour of withholding
· May affect Council position in a competitive environment, market
sensitivity of information and potential usefulness to competitors.
· Negative effect on competitiveness if competitors were to have
access to information.
· Need to obtain value for money.
In all the circumstances of the case, the public interest in maintaining
the exemption outweighs the public interest in disclosing the information.
Therefore, the information is not provided to you.
