Please treat this as a freedom of information request. Could I please have a copy of the Financial Statement of the PPH for 2011-12, ideally in PDF format, or a hyperlink to it.

I note that in the past you have refused freedom of information requests, and would kindly point you to the Freedom of Information Act 2000, Schedule 1, Part 4, Clause 53 (1)

"(The Governing body of)...
b) a university receiving financial support under section 65 of the [1992 c. 13.] Further and Higher Education Act 1992, (...)

e) any college, school, hall or other institution of a university which falls within paragraph (b)."

In Sub-section 2 (d), it is specified that "(in sub-section 1) in paragraph (e) “college” includes any institution in the nature of a college."

St Benet's Hall is an institution in the nature of a college, or in any case a hall of the University of Oxford and thus falls under the FoIA notwithstanding its possible affiliations with other charitable institutions. Therefore I will be required to elevate things if you refuse this request on grounds that you are exempt from the FoIA 2000 unless you can demonstrate that your affiliation with a separate charitable organisation overrides your affiliation with the University of Oxford with regards to FoI requests.

Dear Mr Carter,

We acknowledge receipt of your email dated 22 March 2013, requesting information relating to St Benet’s Hall, in accordance with the Freedom of Information Act.

In relation to your request under the Freedom of Information Act, we have confirmation from Government that the Hall is not considered to be a public authority, and so is exempt from requests under the legislation. The activities of the Hall are conducted through a privately-owned charity, which is regulated by the Charity Commission. However, without prejudice to this position, we are on this occasion happy to make available to you the statutory accounts of the St Laurence Education Trust (attached), the charity through which the activities of St Benet's Hall were operated in the financial year 2011-12. Please note that these accounts incorporate the financial results for Ampleforth College and St Martin's Ampleforth, also operated through this Charity.

Since 1 September 2012, the activities of St Benet's Hall have been conducted through the St Benet's Trust, and so from the current financial year onwards the financial results for the Hall will be reported through this charity and will be available on the Charity Commission website. I have taken up my appointment as Master on 1 September 2012.

Given the administrative burden entailed in responding to requests such as yours, I regret to say that any further requests will incur a fee of a minimum of £50. We would also normally reply only to postal addresses rather than to email accounts.
