1 - By year, from and including the date of sanction of under-guise investigations/operations by the GDC. Please give the financial cost incurred directly from under-guise investigations/operations instigated by the GDC, or on its behalf.

2 - By year, as above, please give the indirect costs incurred by the GDC, to include, costs of compensation payments to registered dental professionals, legal costs and all other costs, as a result of the use of under-guise investigations/operations.

3 - Please tell me whether monies from the ARFs paid to the GDC by registered dental professionals, or registered bodies, were used for any of the direct/indirect costs mentioned in questions 1 and 2, above. If so, please divulge the percentage of the totally incurred costs used from this source, and any minutes regarding GDC senior team discussions regarding the use of ARF monies for these purposes.

I write further to my email of 13 April 2021 which acknowledged your freedom of Information request of 8 April 2021.

With regards to your second request for the ‘indirect costs’, you mention compensation payments, legal costs and ‘all other costs’.

I would be grateful if you could clarify which specific indirect costs you are looking for outside compensation and legal costs. Are you looking for costs only when the decision was made to instigate an in-guise visit? For indirect legal costs, are you looking for defence legal expenses where the GDC has been ordered to pay rather than general legal costs to defence as well as the GDC internal legal costs?

In addition, if you could itemise/clarify the types of indirect costs, I can make the necessary enquiries, although I should advise you we do not apportion elements such as overheads or staff costs.

We will continue to process your other requests ahead of the deadline of 7 May 2021. However, should you provide information on the indirect costs then under section 1(3) of the FOI Act authorities are not obliged to answer a request where they reasonably require further information to identify and locate the information requested and have informed the requester of that requirement. The date the clarification is provided will become the revised date of receipt of the requested information and you will then be advised of the 20 working day deadline by which you can expect to receive a response.

Please note, this will only apply to the indirect costs we have asked you to clarify.

To quote, "you looking for costs only when the decision was made to instigate an in-guise visit? For indirect legal costs, are you looking for defence legal expenses where the GDC has been ordered to pay rather than general legal costs to defence as well as the GDC internal legal costs?".

No, I am looking for costs even when the decision was made not to proceed with an in-guise visit, but an in-guise process had been mooted and looked at formally.

I am looking for both GDC defence legal expenses when ordered to pay but also GDC internal legal costs (as hourly rate from GDC legal team usage), for all occasions when a formal process to use under-guise investigations/operations has been formally started, whether it ends up happening or not.

To quote, "In addition, if you could itemise/clarify the types of indirect costs, I can make the necessary enquiries, although I should advise you we do not apportion elements such as overheads or staff costs."

The types of indirect costs are as follows:

Hourly rate based costs for GDC internal legal team use on cases where in-guise investigations/operations were formally mooted, whether used or not.

Hourly rate based costs for GDC other staff on the same basis.

Any other costs that have been formally recorded as part of in-guise cases, whether in-guise ended up used or not, and broken down by both year and cases per year.

I am writing to request an internal review of General Dental Council's handling of my FOI request 'Financial costs and associated issues regarding GDC use of under-guise investigations/operations, by year from and including the date of formal GDC sanction of same, to date.'.

It is not acceptable that you haven't disclosed the start date of under-guise investigations. The excuse of having 3000 boxes of files to trawl through is not only ludicrous, but truly hypocritical when the GDC expect dental professionals to have ready access to the documentation commensurate with their roles and registration.
