You requested the following information:

“Regarding planning application 06/2144 and Section 106 agreement dated
1st March 2007, please can you provide a financial breakdown for the
following:
• Dates of when the contributions were spent;
• Dates of when financial contributions received were allocated; and
• The party that paid the contribution.”

We have searched our records and some of the information you have
requested is not held by Brent Council because we do not keep records of
who pays the S106 obligations and, in addition, due to the age of some of
the data, we do not have all the dates available for when some of the S106
money was either allocated or spent. Therefore regulation 12(4) (a)
applies to your request. Regulation 12(4) (a) provides an exception to the
duty to disclose information when information is not held. The
information, which is held, is provided in the attachment: 'FOI
IRC-03194-P3N9B9 Answer'.
If you are dissatisfied with the handling of your request, you have
the right to ask for an internal review. Internal review requests
should be submitted within two months of the date of receipt of the
response to your original letter and should be addressed to:

Please may I remind you that as a public authority, the council is bound by the obligations set out in the Freedom of Information Act 2000, any person making a request for information to a public authority is entitled-

a) To be informed in writing by the public authority whether it holds information of the description specified in the request, and
b) If that is the case, to have that information communicated to him.

In relation to the previous disclosed information, in some boxes it is clear when information is unavailable, but I feel that information is being withheld in sections that are blacked out or obscured.
As a result, I am requesting the full information to be provided without any redactions and within a reasonable time frame as you can appreciate, I had requested this information over 20 days ago. If however for some reason this information is withheld I will request an internal review to resolve this matter.
